I-134

4 posts in this topic

I am currently unemployed but have a good amount of money in the bank. Will this reflect negatively on my I-134?

I read that you need 125% above of the poverty level for 5 years. If I have more then that just in assets will that be alright, or should I get a job in the mean time?

thanks

Usually one can petition using assets or income from employment or both as long as it comply with the poverty guidelines.

jwarren,

The 125% of poverty level income requirement, and using assets to supplement insufficient income at 1/5 their value (now 1/3 for marriage-based cases) are I-864 requirements. They do not apply to non-immigrant cases.

The income guideline for non-immigrant cases is 100% of the poverty level. There is no publicly published guideline as to how assets should be valued to suplement income. Each consulate may set it's own guidelines, each consular officer may set their own guidelines. Lacking something else they may apply the I-864 requirement, or they may not.
