Hey VJ!

I'm in the process AOS through marriage and am waiting for my EAD/AP combo card. I'm getting a bit impatient and need to take a trip home. My question is when the card comes and I leave the U.S. how long usually can one stay out of the country? Can anyone share their stories with using Advanced Parole? I had to leave home (Canada) on short notice so I have a few loose ends to tie up when I go back. I plan to go for at least three months. Answers/advice would be greatly appreciated as I don't want any issues coming back to the States. Thanks!!

I adjusted from a K1. My ead card arrived a week before my adjustment of status interview so I wouldn't have been able to take a trip anyway. Will anyone be at your house incase you are sent an interview letter and if you do get an interview letter can you drop everything to come back for the interview?

I was told when I received my emergency AP that you can be away for up to a 1 year but if you're gone longer than 6 months, CBP will give you a hard time about why you were gone for so long. You should be fine though since you're only planning on being gone or 3. I'd recommend having someone check your mail for interview letter from USCIS and things like that.

Yes someone would be at my address to notify me when I get mail from USCIS When I'm away, so that would be covered. My biggest concern was knowing the time frame I can be out of the U.S. to avoid being further interrogated at the border more then needed.

If it is less than 6 months, you are fine in terms of crossing the border.

The issue MAY be, if you go before the AOS interview, that they will question why you left your spouse for such a long time right after you got married.

The reason why I'm returning home so soon is because I had to leave home just as fast. I literally had 3 weeks to pack what I could back in June 2015 and cross the border to activate my K-1 visa.Due to my medical being done to early back in January I had no Idea the "clock" for entry starts as soon as the medical was done. I originally had my k-1 interview scheduled for February of this year but had to cancel it for personal reasons and was under the impression it was valid for 12 months. With everything being rushed my now wife and I had to do a quick wedding at are local city hall and now are forced to stay with her family in a relatively tight space until we get a place of our own place. I just want to go home for a bit, gather myself and hopefully we can move out shortly after I get back to the U.S. Is my reasoning valid if they ask? because that is the honest truth.

I think so, but it is not me you need to convince.

Make sure you keep evidence of you two staying in touch, any visits to eachother etc.
