Not well informed enough, to ask the questions I need an answer to.,.,.not sure what to do!

Hello fellow VJers,

I hope I do not make a total, mumbling, bumbling fool of myself trying to ask a question my wife has brought to my attention. We have to file ROC, in about 2 weeks, and she waits until now to bring this to my attention.

MODS, if I am not posting in the correct thread, please move me, as I feel very un-sure and quite "scrambled" working on ROC, then get "hit with this potential" problem from my """Filipino wife"""..,.,.yeah, I still love her to death.,.,.hahahha!

OK, filed AOS, no problems, no interview, no rfe's.

We used her new married name and her maiden name when asked for it. All went fine.

So, almost 2 years later, we are ready to file ROC, by Oct. 4.

For some reason, she asks me if her passport saying her name as Joy Mxxxxxxy...,., middle name Caixxxxan, (Filipino passport, went to Out Reach here in the South East when they were close and got new passport)when her 2 year GC says her true married name, Joy Son Mxxxxxxy.

So, for her, she has two names, and if ever had to use the passport, with GC to travel, IT WOULD be a huge problem. GC, drivers license, marriage license says Joy. S. Mxxxxxxy.

HER PASSPORT says her name is Joy Mxxxxxxy..,.,.,.,middle name Caixxxxan.,.her maiden name,.,.,.,MY PROBLEM.,.,.,.,.is her middle name starts with an """S""" and her former Maiden name has nothing to do with her new married name.

So passport looks like this: Joy Mxxxxxy

middle name Caixxxxxxan (SHE SAYS HER FILIPINO PASSPORT SAYS HER NAME IS JOY ""C"" MXXXXXXXXY! She says, Filipinos use the former maiden name as the middle

name, when new passport is issued.

Her GC, drivers licens, marriage license, SS card, work I.D. card.,.,etc, shows Joy S. Mxxxxxxy! (How can Filipino passport not use her real middle name, begins with an ""S.""

I am confused just trying to type this, I hope someone who has experienced this, can "set me straight"..,..because this ROC, has me scared stiff, it is so much material to submit, and I am

not sure if they ask for passport info. page.

Please have patience, as I do not "rattle" very easily,..,.,.but I am really rattled..,.,.,.,too much to deal with at one time. I.,.,really look forward to some knowledgeable VJers, to help out! Thanks, in advance!

USCIS seems to have a satisfactory paper trail up to this point. They've certainly encountered Filipino applicants before. (Traveling internationally might be another story, and others can comment on that, but that's not the issue now.)

I recommend setting your confusion aside temporarily, sitting down with a pen & paper, and constructing a concise version of the "chain of events and Filipino customs that have led to the name-changes." Put yourself in the shoes of a stranger who wants to understand "what happened when, and why."

This is something that you can do. Perhaps let an American friend hear or read what you've written, because you might get recommendations on how to improve the clarity.

After doing this, you can again reclaim the fear and uncertainty that you temporarily set aside, or tell those emotions to take a long walk off a short pier.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I knew I could not set this in type, to accurately reflect the situation, a lost of pressure right now.

Thanks for your response, I will put this in a better context, for my next post about this, I am just really rattled at this point in time. Hope I got the right forum.

You're as rattled as you decide to be. Remember that you're the world's leading expert on your wife's name-changes, so you get the opportunity to educate others about it.

This is my second attempt to explain our problem, if there is one. I will keep it as short as possible.

We were married by K-1 visa on 6-22-2013, here in South Carolina. We filed her AOS, SS card, and we received her EAD/AP card, SS card, and 2 year GC as of 1-2-2014. ALL documents has what was on the marriage license, ""Joy Son Mxxxxy."" Will file ROC on or about October 4, of this year.

Now, to the problem.

In late July of 2014, her Filipino passport expired.

We traveled to Georgia, to the Filipino "Outreach Program" who travels around the south east, renewing passports and other documents for Filipinos. We paid fee's for passport, and received it about 3 weeks later.

The main page of the passport shows the following:

Surname: Mxxxxy

Given name: Joy

MIDDLE NAME: CAIBIORNE

Then all other information is correct.

On every document we have received from USCIS, and marriage license shows the name as.,.,..,""Joy S. Mxxxxy" or Joy Son Mxxxxy!

These passport people have moved her "Maiden Name" to her middle name. My wife says, "it is the Filipino way, it is what they do." I just cannot imagine how her GC, drivers license, and every other document says her true married name, Joy S. Mxxxxy, and the passport says her middle name is her Maiden name.

I personally do not see how she could travel internationally with a passport saying her middle name is her "maiden name."

Please, all comments is so much appreciated, it is a shame, I did not notice this sooner, my fault there, just please advise and help!

This does seem to be the way. I too am married to a Filippino for the last two years, ready to do our ROC also. I dont have a problem with the name on all of the documents, I am just confused because her maiden name she uses as her middle name also. Not only that, all three of her adult children use the maiden name also for their middle names. So, my wife and her 3 adult children all have the same middle name using her maiden name. Very confusing and will never understand it. But, I know through the decades, record keeping in these poverty stricken countries was never done, births, deaths, divorces. Etc. In fact my wife and many Filippinos, particularly the older generation, dont even know their own children's birthdates. Mostly they will remember the month, but not the day or year of the birth. Again, very confusing. Good luck. Sometimes, I think they go through life changing around the names and using different names, because the laws are completely different in these foreign countries then they are here in the U.S., and they are pretty much allowed to do with their names as they wish.

Thanks for responding, I just see "no way" she could ever travel to Philippines, with a passport like this.

That is my main concern,.,,. but it seems to be a normal thing for your family. Have you tried to use these passports, with "her maiden name" being used as her middle name?

yes that is how is done in the Philippines her maiden name will be her middle name since she is married. for example( I will only use the first letter) on my and my wife marriage certificate it shows her name as A .V.F on her passport it shows as A.F.J

an d if you have children the maiden name will be their middle name also if you do the Filipina tradition

I do wonder why your wife gc and other documents was not change like that

After we were married all my wife documents was change with her new name

The Philippines won't issue your wife a passport using her maiden middle name and your surname. It' a Filipino thing.

However, since your wife uses a different name, she will need to get a document from the Philippines Consulate called "One and the same person."

That should solve the problem.

Yes the will my wife is filipina her passport has her maiden name as her middle name her old middle name is completely left out.

In the philippines the maiden name will become the wife middle name and her children when she is married

Again, very confusing. Good luck. Sometimes, I think they go through life changing around the names and using different names, because the laws are completely different in these foreign countries then they are here in the U.S., and they are pretty much allowed to do with their names as they wish.

You need to read my previous post again.. I said "maiden middle name," not "maiden name."

ok my mistake I am just use to seeing maiden name meaning former last name. that is first I seen it in front of middle name

agree the above post is garbage just because Americans do not understand why the Philippines or other countries change their names the way they do does not mean there is no reason for it. No they are not allow to do with their names any way they want. they do their names the way their government requires them to
