Question:

Can my husband(petitioner) include the amount of tips he earn in cash from customer to calculate his current income for the I-864?

Any advice would be highly appreciated!!

You'll probably need to report what the tax returns & pay cheques actually say, else it's not going to add up, huh?

Yes I realized that now, the fall without tips is 2844 and that multiply by 3 is 8532, he does have a separate savings acct. with his mom of 10,000 and a single acct. in stocks for another 2200, do you you think I can include those as assets?

Yes I realized that now, the fall without tips is 2844 and that multiply by 3 is 8532, he does have a separate savings acct. with his mom of 10,000 and a single acct. in stocks for another 2200, do you you think I can include those as assets?

Why don't you play it safer and get a joint-sponsor since it sounds like you're on the edge of meeting the income requirements? His mother could withdraw the $10k and the stock market isn't exactly on the up and up this week. :)

I wanted to avoid the joint sponsor, the only person I can think of is his father and he is a total mess when it comes to tax. He don't know where he leaves them, he is retired but rent 3 homes so he have income from that or I can ask him about his bank account he just sold a house for around $300000. I'm not sure what to do. My husband have a retirement account in stocks for 108000 but they told me in VJ that the USCIS won't count it as asset. I'm kind of lost here.

Ok, so my father in law is going to sponsor me, his gross income from last year was around 300,000 but he filled tax with my mother in law. Do I have to make an I-864A for her? Because with his pension alone I'm well over the minimum. So do I make another I-864A for her or no?

The section in bold and red refers to income, you don't multiple income figures by 3, that is only done when a petitioner is using assets to qualify. The section in bold and blue is an example of using assets, petitioner multiples the sum by 3; joint sponsors must multiply by 5. For your case, 10,000 plus 2200 multiplied by 3 is insufficient to meet the requirement.

If he can clearly show the income comes from him, then an I-864A will not be necessary.

Yes, he have a pension, and I believe is very big because he was a civil engineer when he was younger and CEO of a company so I'm pretty sure his pension is big. So I guess I will only include the pension he have for 1 year and the total household is 3 including me, him and my mother in law, I asked him if he reach a minimum income of 30,000 to sponsor me and he told me no to worry that his income is way over that, he send me his forms 1040 from 2012(gross income= 194000, 2013=201,905 and 2014= 311,624) so I got a little bit of confidence that he is a good sponsor plus is my father in law. Do you think is ok if I only include his pension since he is retired, he also have SSI( from work, not aid or welfare) but he told me the pension alone is more than enough. Any advice please!!!!!
