CR-1/2 Questions

I'm need some advice and a guide on CR-1/2 process.

First a little about my situation to make sure I'm doing everything the best way possible.

In July 2014, I applied for K-1 Visa for my ex-fiance and was received by US Embassy in Manila in November 2014. In December 2015, I was told by ex-fiance that she became pregnant by her Filipino boyfriend (hence ex-fiance). I since have a new fiance, we met and got engaged in June 2015. I actually knew her before my ex-fiance. I know she truly does love me, even after I broke her heart last year when I got engaged to the ex-fiance. I met her family and have their blessings and know she doesn't have any boyfriends. She has a 5 yo girl from Filipino bf that left her while she was pregnant. So I guess God brought us together at the right time.

I am going back to Manila this September to get married there in Philippines. I have already scheduled appointment at US Embassy in Manila to get "Proof of Eligibility for Marriage". We are going to have civil ceremony for marriage.

Since the K-1 Visa package with ex-finace is at USEM - Manila, I already emailed and DHL them last month, informing them to withdraw my K-1 Visa petition with ex-fiance. I don't think the K-1 Visa will impact my CR-1/2, other than making sure to include documentation of withdrawing K-1 Visa petition with I-130 filing.

It wasn't real clear reading though the CR-1 guide/wiki and forums how to petition spouse with child. Could someone point me out to an easier guide/wiki for completing the CR-1/2 process for USC marrying Filipina with child?

Also what are timelines from filing I-130 to getting CR-1/2 visa's? I've heard from some that it has been as fast as 5-8 mo's, depending upon whether there are any RFE's.

Beside that you will need any divorce papers if you had ever been married before. Also you should order cenomar for you. They may ask for that from you. It will just show no record found since you have never live there.

When i got married over there i had a copy of cenomar record for me. I can not remember if I actually needed it or not but it is better to have something you do not need then not have it

I'm confused. Your profile says your chasing a K-1 visa but your filling and asking questions about a I-130 (IR1 visa) which is for someone who is married (married in the Philippines) and filing for a visa for their wife to join them in the USA.

You do not need the cennomar to file with the I-130. The local civil registar there might ask for it to issue marriage license. You can order it online at the Nso website it does not tame that long tk get

You can just put N/A for the question of living together. USCIS understand that most couples living in diffrent countries may not have live together yet

I read so many, so to keep my answers I follow the conversation from one entry to the other. So, I did read your long story and I gave you 4 places to look for your answers. Also, here is some additional information that I had on file.

If you are preparing to submit your I-130 petition packet for a spouse, your packet must contain the following:

1. I-130 petition

2. One passport-style photo each

3. Check for $420

4. Copies (not originals) of your birth, marriage and any divorce documents

5. Photos of you together

6. Proof of travel to the meeting country and being together

7. Proof of some cohabitation and commingling of assets.

Good luck. If you can send an email to a great guy who just completed is IR1 and Cr1, his name is Brassballs I'm sure he will help you. If I am correct I think he had a post about the steps not to long ago. Look in his profile and look for the tab on the left side for "posts" and you will see his history of every post he has made.

base in my experience, you need to bring your BC and divorced paper if you are divorced you not need to secure CENOMAR here in Philippines, your fiancee who need to get CENOMAR, after you get legal capacity to marry at USEM and CENOMAR for your fiancee at NSO you both proceed to local civil registrar in place where your fiancee are living then secure marriage licence it takes 10 days to release but I not sure for other LCR how long their processing time. after securing all then set your civil wedding ceremony with Judge or any person have legal authority to conduct/ solemnize wedding, GOOD LUCK and best wishes

I know when i got married in the Philippines in may 2014. I got conflicting answers on if american needed cenomar . I went ahead and order one it just said no record found since i never live there. I am pretty sure the person at the registar ask for cenomar for me and my wife.

The op will not need bc as his passport will be good enough his future wife will need her bc

That is a good list but the op will also need 2 G-325a forms for each with passport photos

number 7 is not really needed as me and my wife did not have any type of co mingling of resources or any type of cohibitaton together

Neither of us required CENOMAR when we got married there.

As far as last address lived together, I put her home address cause that where we are staying when I go there.
