Dilemma - I-864 Income

Hi Guys,

I was just finishing up completing my AOS/IV Package and ran into a slight bit of an issue.

For 2014 I was well above the poverty guidelines, for 2013 I was slightly above the poverty limit HOWEVER for 2012 I was below the poverty guidelines.

I know you can send in last years OR the past three years transcripts but from what I've read Afghanistan requires all three years (any afghan members that can chime in here??)

Anywho ... would I be fine if I sent in all three years transcripts with a current employment verification letter indicating my income? Or would I have to obtain get a joint sponsor?

BTW: I didn't have sufficient income for 2012 because I was a full time student - do you guys suggest I write a letter and document why it was like that for 2012?

I don;t think you will have any problems. Write a short explanation, and prove that 2015 income will also be well above the poverty line, and you will be fine.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yeah I agree with above two write a short explanation letter and provide evidence that your 2015 tax return will be above poverty guidelines in my case my co sponsor filled for extension for the year 2014 and we submitted it as a proof as we didn't had tax return of 2014 and wrote an explanatory letter as well.

But the fact that I was under the income limit for 2012 ... that shouldn't pose as a problem?

So ... just write an explanation stating I was a student and that's why 2012 income is so low.

AND the employment verification statement from employer indicating my current income would be sufficient than?

I wouldn't bother explaining 2012; they'll care more about current income, so I'd just put the employment letter in there.

We sent pay stubs from the start of the year (sent end of June, so 6 months worth at the time we sent it)

So I'd either say 6 months, or from the start of the year

I don't think they will worry about 2012. I sent my job offer from 2014, which had the annual salary, but also pay stubs from all the months in 2015 up to interview date. CR-1 is more stringent than K-1, but current year income is more important than 2012 pay level.

Question - I read on the commonly made mistakes site for the US Embassy in Kabul that you NEED to have the I-864 notarized.

Is that correct? So I will have to go get it notarized?

And the other question is on the website it states I-864 and I'm completing an I-864EZ.

Will that be a problem or should I do the I-864?

I don't know if you should do the I-864 or I-864EZ, but I would suggest you get it notarized. I don't think this is a requirement of other embassies, but even with the I-134, I got that notarized. Of course, for the I-134 it's completely unnecessary, sending anything to Kabul is an investment. I would say to notarize because they won't pause your case if it is, but if they want it notarized, they can request that document and pause the whole process. Better to give more than necessary than to miss an opportunity!
