There is a lot of spurious information, as I see it:

You left 5 years ago to your home country.

You have had various jobs locally.

You filed a SB1 and it was refused.

So yes you can seek entry. Most likely the POE will refer you to an IJ, hopefully they will parole you in, they could detain you.

I would certainly find out if taxes have been filed if you want to give it a go then you need a Lawyer familiar with abandonment issues, very few are. You need to make sure they have tried such cases.

My first thought was why you wish to go to the US?

That´s why I want to find out about the taxes, I just have to figure out how. And how can I pay for any possible debt I might have from the past. Like I said, I was the one working, he was the one in charge of paperwork (or so I thought). And the reason I want to come to the States is because I admire this country, and have lived a lot of really good things in it, plus I have a lot of old friends here. Aside from that, I feel completely trapped here right now. You talk about abandonment issues regarding the GC, I also have my abandonment issues regarding my personal situation. My husband left everything back here, he just took a few clothes and that was it. So pretty much, I feel like if I don´t get out of here, I will become crazy just from waiting on him coming through the door some day, and that will probably never happen

So exactly what is it you want to do in the Marine sector and why do you need a PR tob do it?

I´m right now a QMED (qualified member of the engine department), and would love to join the Merchant Marine. Which here in Spain is pretty much dead. I have the academic education to become a Marine Engineer, but I need now my offshore working days to complete it.

As far as the B Visa, all I know is that the yacht crew agencies ask for it. It could be because of the convenience flags. I know that it´s not possible to work regularly on a B Visa, but I do know also that for some boat jobs is needed, so I´m confused about the legal intricacies as well.

aside from what everyone else wrote - it seems that your spouse has been filing taxes for both of you. This means he probably put you down as a dependent not employed so he could get more money back. I would contact the IRS and talk to someone about this. You know your social you can have them look into this.

I hope everything works out for you and even if you don't believe in divorce - it might be what is best with everything you wrote.

I´ll be definitely looking into it, thank you. I have put up CV´s in several yachting agencies, and asked my husband a while ago about finding out the requirements to validate my title and certificates in America. Of course, he never did it

I truly hope he had. I really need to know this. Also, he put me on his car insurance last year as a resident non driver. I don´t know why he would do that, since I wasn´t living with him. I also know he took me out of the insurance when he closed our joint bank account.

He also told the bank that I was separated, I had to call the bank to modify that info. He still shows up as married though, the moment the bank changed my status to married again he showed up as my family member again.

As for divorce, I might really be that stupid, but I hope that someday he manages to get over this ridiculous midlife crisis he´s having and comes back to his senses. Of course, it might be too late by then, but I need closure, something he refuses to give me. I also feel that this woman will destroy him to the point of no return, and I don´t know what to do to be able to help him.She will compromise his disability pay, making him sign something for her, like a loan or something like that. It wouldn´t certainly be the first time she does something like this. This whole thing is so unfair in so many levels

You said he isn't working. You both don't have a child together i am a bit confused as to why you want move here.

I don't support rushing into divorce but he's cheating and he's not talking to you and you haven't indicated that you want to come here to work things out but "[to live the life you used to before moving to Spain]".

Well, things aren´t working out well in Spain to begin with. And yes, he IS working now, he just wouldn´t do it while there was somebody else (i.e. me or my parents) to provide. And of course I would love to work things out with him, but what else could I do? He refuses to talk to me, he even had the nerve of letting his mistress sending me nasty threatening messages through facebook, I had to find out he was cheating on me because of her, otherwise he wouldn´t muster the backbone to tell me himself, I told you also she´s a well known piece in the area, typical trailer trash, benefits chaser, a cheater, a liar who would destroy him without any compassion, what else do you expect me to do if he´s throwing away 12 years (11 married in a few days plus 1 more dating through letters while he was deployed into Iraq the first time)? Yes, 12 years of full love, support and blind trust, through good and bad moments. I entered the marriage in good faith, never once let him down, I never was jealous or possessive, I let him go first and solve his issues, and now that he´s set he decides to kick me to the curb. What else am I to do aside from what I have already done? I honestly don´t know.

No one can make him reason and work things out with you but him. He has to be willing to do that himself and it doesn't look like he is at the point yet.if i were you, i would build my life over there where you have family.nothing is absolutely promised when you move here.

If you turned in your greencard to the U.S. embassy in Spain, you would be allowed to travel to the U.S. on VWP, Right?

At least that gave you some time to see where things with your husband are and if it looks like your marriage can be saved, you can apply for a souses visa to come back here permanently.

The visa would take time but it would give you the chance to travel again.
