spouse visa vs Fiance visa

Hi,

Who are you going to scrutinize more; 1) a spouse who will get a green card upon entry or 2) a fiancée who has to jump through another set of hoops (AOS) to get a green card?

I am just wondering why the fiance visa i faster , while the couple are not married , but the spouse visa in which the couple could have been married for years, but the visa takes longer time , and sometimes the spouse gets denied.

The green card process time is just about the same from what I can see. I don't see so fiance's many getting through the process in three months, so are you looking at the entire process or just the USCIS part?

In the fiance's process, the USCIS has less to do in the beginning, and finishes it all when the couple meet the marriage and AOS requirements. In the spousal process, the USCIS does all the work they do for the fiances all at one time. The DoS (USEM) gets the same shot with the couple with both cases, so they treat the K-1's like immigrant visas. The fiance's need to wait too, but just their time is divided and they get to wait the rest of the process together.

I know it's frustrating and a little backward, but these are the reasons. I wish spouses and fiances could get a visitor's visa easier while we waited!!

I wish the wait in Texas service center is only 3 month for K1 when it's actually 6+ months.

USCIS makes more money with a K1. Imho that's all there is to it.

Hi VJ members , I noticed that fiance visa I-129 takes about 3 months or less to be issued but spouse visa from 1-130 takes about a year or more to be issued .

Why is that ?

Yes, it's illogical that fiancee can get to US quicker than a spouse.

Filed AOS after K-1 and marriage, had EAD/AP in less 90 days, and 2 year GC in about 5 months, maybe less.

Just facts, each person should select his own "path" to where he wants to go, and how.

If humanly possible, the best path, IMHO, is a spousal visa, and with the spouse entering only after the 2nd anniversary.

One thing never mentioned is some countries finance visa is not fast

may go thru the process faster but will be denied if the country is a high fraud country

and then the couple have to marry and apply for spouse

so, the whole process is delayed

sorry to say but any and all African countries fall under the high fraud category

so, VJ members do not tell every country that finance visa is faster / not always true

The words "in general" seem to be appropriate when referring to time frames for visas.
