yes we filed our taxes as married filing separate , another friend did the same and no issues .I did not thinks its law to have to file a joint return. I filed and he did as married filing separately. We have checking account together Lease utility bills for gas and electric ..What else do they want ? I know every case is different and it depends on the office etc But advise appreciated .

I am from Ireland Husbands from Peru I am petitioning him. Up till now not one issue we he has conditional card that expired now has a year extension as they were backed up..

he has 2 children they live in Kansas USA both have GCS ..

Hi,

Could you give us a detailed list of exactly what you sent with your application? And you are correct, married filing separately is not a problem, but a lack of evidence surely is. :)

Hi All,

We received the RFE today we are together since 2007 married 2011 we have lease utility bills the normal stuff but we have no children together ..

My husbands nervous we have till September to submit documents but of course we wish to do it sooner.

Oh plus now I work for US Customs in VA which are merged with DHS.I work in I.T so any advise appreciated.We came this far with no issues.

"Okay let me clear some things UP now we are the removal of conditions my husband was granted EAD no Problem Then same happened again NO Issues was granted 2 years conditional GC.Of course that expires as it is.

We sent in the paperwork and they said our TaX returns were not good enough as we filed married filing separately.. so they want things like Will, Insurance policies things of that nature.

WE have our lease which was amended 2011 and my name physically added and we have electric and gas bills and Bank account statement for checking ..

That's all we have he has 2 children in Kansas with his ex wife I preferred to keep my own bank account as sometimes his wife makes request for money so we both are the real deal happy never argue over money nothing..

Anyway else in the same situation..

Maybe they lost what you sent them, I think you sent them plenty. I'm surprised that was the reason for the RFE. I would send them joint checking and joint bills again. I agree with someone who mentioned you should have things since you got married. But I'll be honest my wife and I don't have any joint accounts, there is never a time except for holidays we get mail with both our names on it. I do file joint tax returns though. Maybe send wedding photos. Or family photos. I think we sent some of those with her and my entire family at xmas and stuff.

THank you I agree its not mandatory that we have all things together and hes ex wife well she come asking now and again for money.So we have a joint acct for normal bills and we are fine Happy etc :-) Yah i got the letter Saturday and I know work for CBP/DHS :-) in the I.T dept..

You repeated your question 'what else do they want' above, I am wondering if you missed the suggestions in previous posts ?

Will, living will, power of attorney, life -car- health- dental insurance, title, gym, receipts from traveling together,

there are several options that you can add. You can send the same things again but if you don't add more items it will get you denied.

They want more so give them more and wills and ( life) insurance are strong evidence, pictures aren't.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
