Maybe you'll get lucky and someone will be aggressive against you and you can shoot them?

ya, he can't successfully use the 'self-defense' thingie here, as he was the instigator of the melee. oh well. lesson learned, in a bit.

Not to derail the thread, but quick story from yesterday. Wifey and I were walking the dog down our usual bike/walking path through a wooded area in our town. About 1/2 way down the path, coming in the opposite direction was a guy wearing a t-shirt and jeans with a gun and holster tucked into the front of his pants. My first thought was "here we go", but the guy just walked by and nodded. On our way back to the car, the guy came back in the opposite direction with the same head nod and kept walking. Since when did Mass become open carry?

the guy provoked the incident.

Does not matter. Once the person got out of his and approached the other guy vehicle, He can use the "Fear For My life" and protect himself.

Since the guy used his fist and hit him, I am surprised he was even locked up....

Not there he wasn't, at least not legally, it's a public bike and walking path. It was a smaller sized handgun, so I doubt he was hunting any game with it.

actually, it does matter. he cannot provoke an incident and then use the fear for his life mantra.

I gonna say it don't matter. Even if he called the person a name, does not give the other person the right to come up to his car and strike him.

Somehow I think you were smiling when you wrote this...

You just can't get pissed off and jump and run up and start punching someone in a car, no matter what the person said to you.

I can put myself in the same situation. Actually I was on the other end, Merging on Highway and other person got pissed and we were honking and cussing and we pulled over on shoulder and I was pretty hot and I got out and approached his car, He pulled a pistol on me. So I stopped, I considered for a moment to get back to my car and get my gun but figured it wasn't worth it.

I did analyze the situation afterwards and came to the conclusion if he would of shot me it would of been my fault.....

Why not, Zimmerman did.

You should have gotten your gun, then you could have had a good old fashioned shoutout like they did in the wild Wild West. Think of the adrenaline rush.
