CSPA . NVC said my brother is eligible but I dont think so

Actually, his PD first became current in August 1, 2013 when the entire F2A category became C (for current).

The beneficiary did not "sought to acquire" an immigration benefit before retrogression, so the PD becoming current the first time is irrelevant.

The PD becoming current again and under which the beneficiary is seeking an immigration benefit. This is the only one that is relevant.

More complicated than the simple answer the OP needed.

Lets see if all goes well in August and he gets visa then he has to come back to usa before September or he can travel afterward. I am little confused and also lipslikesugar00 can you tell us how your case was delayed so much?

04/21/2015 - NVC received Case

04/29/2015 - DS261 filled

05/02/2015 - Case under CSPA review

06/04/2015 - Supervisor review Initiated-Wait 42 days

Do you mean the time uscis took to approve it ?

I have no idea :-/

Regarding why it took so long at NVC it was my brothers fault ... He kept sending incomplete stuff ...
