Visa expires and not send package in time?

Hello,

My visa expires soon but me and my husband still need a few thinks for the package.

How big of a issue would be if we send it after that?

I am on a lease and until we don't find someone in my place I can't be on the lease of the apartment that me and my husband we rent it. And it's in the same building that I live already.

I hope we move faster but my roommates can't decide yet.

Any thoughts ?

I know sound weird but because they can not afford the apartment without me I can't be on two leases.

The leasing office can not add me on my new apartment lease until my roommates find someone else in my place so they can sign a roommate release form.

Okay well try and see if I can figure it out. You are doing an Adjustment of Status? From what type of Visa? You keep saying your Visa is going to expire what Visa? what does your Visa expiring have to do with your leases and you filing? That's the information we are asking.

My current visa is a B2 visa- tourist visa.

Yes, I have to do an adjustment of status.

For the green card process, me and my husband we have to show that we are on the same contract lease. We gonna move together in the first week of July because we were waiting thee apartment to be ready for us.

Or I do not have to show that when I send the first forms?

a lease in both names is one of the things that is useful when filing the I-130, as it's part of the 6 types of bonafide marriage evidence.

So, it seems you are worried about this evidence plus a perceived overstay of the B-2 visa.

I say don't file the AOS set yet,

as

any overstay is automagically forgiven when the green card is issued,

and

you are trying to build up your evidence casefile prior to submittal.

As soon as my roommates decide who can replace me in our lease, my manager from the Leasing office and do my new lease that me and my husband we are waiting for it. So I am at their hands until they decide.

And I want to make sure I have everything correct and in order and send everything once and not be worried that something that I send can be wrong.

Just wait until you have everything together for the AOS package. Overstaying your visa will not affect in any way. Mine expired years ago since I was brought by my parents at the age of 8 and I am now 25, my sister's expired at the same time as mine so many years ago and she adjusted her status last year through her husband with no problems.

You are ok, just get your paper work in order then file. Over stay will be forgiven, but I would file when I could.

I'm adjusting from expired visa and just got my interview date couple days ago, so don't worry about it.

Do you and your husband have some other documents on both of the names? I mean like a joint bank account or car ownership. I believe it'd work too.

Yes, we have joint accounts, soon the lease for the apartment on our names but i will not be able to apply before my visa expires. What kind of status I will have after that?
