i130 petition for spouse in Canada

sorry if this is not the right place to ask the question

i will be a us citizen soon and then will apply for my wife who is in canada

my question : is the address which i specify while i fill i130 for my wife will be the address to which all the document will be sent ???? o

she would be moving to a different address once i file for her

If for no other reason it'll be faster because fraud is less prevalent in Canada.

Is she legally residing in Canada and will be for the duration of the process?

If she is not a multi-generational Canadian then expect a harder interview, more like an Indian one. EP can certainly be faster. Occasionally it is slower.

If she is not a multi-generational Canadian then expect a harder interview, more like an Indian one. EP can certainly be faster. Occasionally it is slower.

she has a US visitor visa , do you think its better for her to come to us and then i file i130 , i485 ( adjustment ) and i 765 ( employment ) while she is here , rather than filing i 130 and waiting for 8-10 months for her to get a visa ?

i see that with all the other forms i need to file i864 ( affidavit of support ) as well ?

any help will be appreciated

Can't do that legally. It's a visitor visa...everyone would do that if that's the case...that's the exact thing that causes countries to become high fraud and makes visitor's visas harder to obtain. She'd have to be able to convince the border patrol she was going home. Edited by Shauneg

No that's illegal.

The I-864 ends up at the NVC stage. After you send off the I-130 package, then look up the NVC process in our wiki on VJ to prepare for the next stage.

if that is the case , we are thinking of registering our marriage here in US when she visits me and than i can start the i130 process , she will go back in a week
