Timeline

If you leave before having overstayed for 6 months, you won't incur a ban.

If you leave having overstayed 6 months to 1 year, you will have a 3 year entry ban to the US. If you leave having overstayed 1 year or more, you will have a 10 year entry ban. If you incur a ban, a waiver would need to be filed and approved before you would receive an immigrant visa.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

So i will be banned here in US if i didnt go back to my country?? Oh god My situation is so complicated ? i have a child born here on feb. 2015 he's only 4months old and nobody will take care of him if ill go back to my country coz my husband has work ??? what do you think is the best thjng to di with my case?

Your son is a US citizen, you can apply a US passport for him so that he can travel with you when you go back to the Philippines. Act NOW before its too late. For every day that you spent in the US brings you closer to incurring a ban.

I came to us on aug. 4, 2014. They give me 6 months to stay here until feb. 3,2015. So already 5 months overstayed here. So if i go back to my counrty soon i won't incur a ban? And i can still go back to US anytime with my tourist visa?

Currently, you're overstaying for 4 months+ and counting.

Leave now and you won't get a ban. Once you hit the 6 month mark, you will get the ban.

However, you already violated the terms of your tourist visa so you can't use it anymore. If you try to enter the US again using your tourist visa that will cause severe consequences for you. Stay in the Philippines and wait there until your immigrant visa interview is scheduled.

Oh so my visa wiil not be valid anymore ???? thats make me sad ? its 10years visa. ???

How long do you think before i can go back to US again? I mean the process of my visa?

Process time for spouse of LPR takes more or less 2 years.

Sana nanghingi na kayo ng advice bago ka pa nagoverstay. Nasayang tuloy yang tourist visa mo.

Yeah, problem is Ma oo ver stay talaga ako kasi due date ko ng feb. and same ng expiration ng stay ko my dr. Didnt allow me to travel na going back to phil that time. And pati airlines hindi narin ako aacept. I think better po na bumalik ako sa pinas right? Hindi ba mapa process visa ko pag nandito ako sa us?
