Immigrant visa (IR-2) expired, can I still use the temporary I-551 for re-entry?

Edit: He said he did not pay for the Green Card because he planned to file a citizenship form for me because I got here with the IR-2 visa and I'm under 18, so I'm qualified under the Child Citizenship Act. ( My dad is a US citizen.)

@millimelo, Thank you for the link. :) Though I just talked to him and he said I'm qualified for citizenship under the Child Citizenship Act so I could just bypass the green card and apply for citizenship during this summer, probably after I get back from Thailand. I was just making sure that I can use the I-551 to come back in the meantime. I don't fully understand about these immigration processes though, so I did not ask him about it for quite a while.

As I said we were quite busy so we wanted to get school stuffs done and he just told me that he was planning to file it during this summer break. Though it just came up that I had to go back to Thailand for a while so I'll probably come back early August so I'd have a couple week before school opens and we can apply for the citizenship I guess.

I've been in the US for nearly six months and haven't gotten the green card yet, and my IR-2 immigrant visa is expiring soon. Though, I have to go back to Thailand for personal reasons. Will I be able to use the temporary I-551 on my visa ("UPON ENDORSEMENT SERVES AS TEMPORARY I-551 EVIDENCING PERMANENT RESIDENCE FOR 1 YEAR.") even though the immigrant visa is already expired to re-enter the United States after I get back from Thailand? Thanks in advance!

If you qualify under the Child Citizenship Act then you're already a US citizen and need to obtain a US passport.

Yes.

You automatically became a US citizen on the day all of the following became true:

(i) You are under 18.

(ii) You are in the legal and physical custody of at least one parent who is a US citizen by either birth or naturalisation.

(iii) You are an LPR.

If you meet all of these, you are now a US citizen. Since federal law requires all US citizens to enter and exit the US on US passports, you must obtain a US passport to travel abroad.

Thanks for the information. Though I would not be able to wait for the passport as the situation is urgent, can I use the I-551 on my immigrant visa to travel abroad in the meantime?

Federal law requires US citizens to enter and leave the US on US passports. If you happen to live nearby a passport processing centre you can sometimes obtain one the same day: http://www.travel.state.gov/content/passports/english/passports/information/where-to-apply/agencies.html otherwise you could use expedited service and obtain your passport in around three weeks.

At the same time, I doubt they'll use the thumb-screws if you do not obtain a US passport prior to your trip, but you will technically be breaking the law.

Wow, getting different replies from different people. One of the replies in this thread says I can use the I-551 for one year after i entered the United States :cry:

This turns out to be more complicated than I expected x_x

LPRs can use their endorsed immigrant visas for up to one year from the date of first PoE, but you are now a US citizen and no longer an LPR; that is the source of your complication.

Thank you for the information. I wanted to make sure so I called a USCIS representative and asked about my situation, and the rep said I can still use the I-551 on my immigrant visa for re-entry as long as I come back within one year of the endorsed date, even though I'm under the CCA. And I can apply for a US passport once I get back here.

Thank you for the replies everyone, I definitely learned a lot from this thread. :)
