No deadline filing for AOS? ( from K1)

1. The sooner you AOS the sooner you can travel back home. I would hate it if there were an emergency situation in my fiancee's home country that she couldn't attend to because we haven't done the AOS paperwork and received Advanced Parole.

2. Health insurance. If you are out of status I don't believe your company's health plan would allow you to add on your SO (please correct me on this if I am wrong).

3. Risk. Politically and administratively things change all the time. Fees tend to go up not down. More illegal immigrants may be allowed to adjust and receiving a green card could take a year in the future instead of months.

TLDR. Get it done.

ALL medicals are now only good for 6 months. So if you take too long, you WILL be RFEd for a new one.

Medical is good for a year. The 6 month limitation is in regards to the visa only.

That is a DOS document, not from USCIS (Immigration services)... two different "worlds", for DOS it is 6 months or 3 months (TB)... and the limitation only relates to the visa.

You have all the time you want... We waited two years, you only pay once and get your ten year card. The nice thing is like someone else said, you have a good period of time to make sure it is going to work...lets face it, a lot of marriages don't work whether foreign or domestic... they have a good amount of time to adjust, make friends and decide what they want to do. You actually can go get your driving permit if your I94 is valid, but for most filipinas, driving should be a long, slow, careful process....that can be difficult if you live in the city but perfect for those of us that live in rural areas. With lots of state land, farm land and dirt roads, it is the perfect place to slowly get used to driving.

The bottom line is if you are out of status and not doing anything illegal you have zero chance of being deported. Take as long as you like. It's a long road, no need to rush.
