K1 Visa was neither approved or denied

Timeline

This very scenario just happened to us. My fiance has her degree in Chemistry. She just did her interview at the Embassy in Moscow on the 17th. The interviewer got concerned when she mentioned her chemistry degree and explained how she studied synthesizing anti-cancer medications. He asked for a resume and now we're in the dark. Of course we ended up buying plane tickets for 2 weeks after that date thinking everything was going to work out. I guess he mentioned it would take a couple weeks. Anyone have an update on how long it really took once the resume was sent in?

Hmm...upon further review of 9 FAM 40.31 (instructions that the CO uses regarding things like the TAL and so on) it seem's as though, unless your beneficiary indicated to the interviewing officer that they had a job lined up, or was seeking a particular job in a particular field with a likelihood they would have access to technology or research that was "flagged" on the alert list, the CO should not have invoked the administrative review and should not have submitted for a SAO to Washington. In other words, it seems from everything I've read this weekend that the TAL and SAO's are mostly for those seeking work visa's or student visa's with a particular job already lined up (usually via a corporate sponsor). If this end's up delaying you more than a couple weeks, I would start asking serious questions about why they deemed your fiance a technology risk...unless it was some other issue then all bets are off.

By the way...update on your case so I can gauge the SAO timeline?

I'm sorry to hear that!

Well, chemistry is on TAL list as well as computer science.

And it took us 3,5 weeks to get all cleared

I'm the petitioner

  • Met: August 13th, 2010 month later decided to start relationship
  • Proposed - Jabuary, 2015
  • Decided to apply for k-1 visa - March, 2015
  • Sent I-129f to USCIS - March 27th, 2015
  • Got notification on I-129f - March 31st, 2015
  • NOA1 - April 7th, 2015
  • NOA 2 - April 30th, 2015
  • NOA 2 (hardcopy) - May 4th, 2015
  • NVC - May 13th, 2015
  • case sent to the embassy - May 15th, 2015
  • Ready to schedule an interview in embassy (on CEAC) - May 19th, 2015
  • Documents arrived to Russia and can physically schedule an interview - June 3rd, 2015
  • Interview (!!!!!) - June 11th, 2015 (neither approved or denied)
  • Administrative Processing - from 11th of June to July 15th

Green card:

  • Sent i-485, August 7th, 2015
  • Notification that they received it - August 13th, 2015
  • Noa-1 Sent to us - (were on vacation, got it on August 22nd)
  • Fingerprint appointment - September 1st, 2015
  • Walk-in - August 24th, 2015
  • RFE - August 26th, 2015
  • RFE evidence received in USCIS - September 14th, 2015
