From the other OPS it looks like it's not the end of the world like I thought. We filed our AOS by normal mail on the last day of 90 and they didn't say anything. I don't know why people lose sleep over things like this. Having forums with people screaming you'll be deported probably doesn't help, but just like everything else in life there is always a way around every obstacle.

AOS is different. You must get married before the 90 days is up, but there is no specific rule about when to AOS. Some people don't have the money right after they get married, so they wait, and it's ok. ROC, however, is a ttotally different matter.

Even if evidence is not compiled, the evidence can be sent later and this fact is ascertained by the statement in the NOA you receive.

Must send the application though.

Not too sure that would really help in this situation, since USCIS may then deny the petition. Sounds more like jumping from the frying pan into the fire.

Thanks for all of the feedback, I will be sending it tomorrow(2 days late). I will surely have an explanation for the late sending. And its funny how a personal opinion ran right to deporting her???? Well if that's worst case scenario, sitting on the beach in the Philippines waiting for some paperwork to clear immigration sounds perfect to me!! I will update my findings. And yes, probably not going to drive it to the California Service Center.
