I agree with those who said you should probably have went by yourself. I highly disagree with those believing she should cancel a trip to go to an interview. It does seem odd not vacationing together, but I can't say I would not do it myself. My wife certainly vacations with out me, but someone has to make the money to afford the vacations. I don't think you will have any problem if you can show them tickets or something was booked before you got notice of the interview I'm sure they will understand. I agree honesty is best policy in this case, I don't think you have anything to worry about. Rescheduling a court date isn't that big of a deal, I don't see this being any different. The federal government works for us, not the other way around. Good luck!

determines if he can stay here or not. If a vacation trumps that then why bother starting the entire visa journey !

This isn't about her vacationing alone, this is about being responsible and attending an interview that can be the difference of being approved or denied

due to abandoning. Re scheduling a court date is done BEFORE the date not after the date of appearance.

OP will be lucky if they accept his request and if not they have to pay another $1070 to start over, to re book the ticket would have been cheaper.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Then I'm sorry but you have no idea what you're talking about. This is not about his wife deciding to go on a vacation without him. This is about her not attending THE MOST important interview, the one that determines his future. No, this is not like re-scheduling a dentist appointment. Do not attend the interview and there can be harsh consequences.

I would take a bet in a second for $1070 that if this happened to me, everything would turn out alright. To me you sound like someone shouting fire in a theater when someone lit a lighter. I can't speak for the OPs relationship, but I have no doubt this would not cause problems if it happened to me. I wouldn't wait until the day before though, there just seems to be a lot of fishing things going on that don't add up. But missing or rescheduling an interview for a previously planned trip, never in a million years would I believe there would be consequences. Assuming a canceled trip is less that $1070 isn't that great either, I usually pre-book air and hotel which I think 3k is a good deal getting both but normally it's 5k or higher. I wouldn't have booked a trip, but if for some reason I had I wouldn't cancel it for an interview.

Wow, you really do not grasp how important this interview is. How do you think it looks to the interviewer if both partner do not show up to the interview? You think it would have a positive or negative impact on the image that the two of you have a good solid relationship? How could you prove that with the wife gone?

Priorities need to be assessed for everyone who thinks a pleasure trip trumps an AOS interview.

I am not shouting fire due to a lighter, this is an inferno and any carelessness will have severe consequences and burn the house down.

You are free to chose your own options when the time for your own AOS comes but a little research goes a long way to make

an informed decision rather than having the attitude that the government works for you and everything will turn out for you because you are you.

Experience is also a very good teacher.

Rather than misleading OP with "all is good" he needs to be informed of the hard facts.

Again, it will depend on the adjudicator's discretion if he will allow another appointment after not taking care to re schedule ahead of the

interview time and that is it.

USCIS is within their right to deny according to their regulations :

8 CFR 103.2(B)(13) states in pertinet part:

"...If an individual requested to appear for fingerprinting or for an interview does not appear, the Service does not receive his or her request for rescheduling by the date of the fingerprinting appointment or interview, or the applicant or petition, the apllication or petition shall be considered abandoned and accordingly, shall be denied."

That's a totally different thing, you're saying not showing up and not telling them. The OP said he already contacted them, they want his reason within 30 days. I agree not showing up for any appointment is bad if you don't call or figure out a way to reschedule but that's common respect, doesn't matter if it's USCIS. This is not an inferno.

The OP should have proof everything was booked before the interview, I'm sure that won't cause a problem. Having an interview at all is cause for more concern, then not being able to make it. AOS took 1 year for us, so basically you're saying don't book anything for a year because maybe this AOS interview will come up... ha ha ridiculous. I didn't go on vacation while we waited because I didn't want the ####### storm my wife would bring down on me for going on vacation with out her, but I did have to go out of town for work a few times. That wouldn't have been changed regardless of what USCIS wanted. I doubt any decent person will have a problem with someone having a pre-booked event that same day, now a vacation with out their significant other may bring more light on their case and will present a burden of doubt in my opinion. Everyone has different working relationships, so that would be up to the interviewer to decide.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

An individual may for good cause request that their interview be rescheduled. However you must provide a reason for your absence. Please send a written statement within 30 days explaining your absence with any supporting documents to the following address...

That might be true if he didn't have the email back from him giving him 30 days to explain....

They're not going to accept "oh, my wife just decided to go on vacation, no big deal". And I am pretty sure they don't tell you one week in advance "hey, it's time for your interview". The moment they got the notice of the interview and realized it would be during his wife's visit they should have re-scheduled the interview. No excuses.

That might be true if he didn't have the email back from him giving him 30 days to explain....

Prebooked vacation is not a good cause. Birth of a child, death of a family member, natural disaster, these all sound like good cause.

The problem isn't so much the vacation, but rather that he didn't frantically try to re-schedule the interview and instead waited for the day before to do it (I'm assuming you have more than just a day's warning for the interview).
