Timeline

I´m a US citizen living abroad for more thant 20 years. I´m living in Ecuador. I got married to an Ecuadorian woman. We have been married for 2 years and 9 months by now. She has a B2 tourist visa, she got that visa before we got married and the visa is valid for two more years.

I was addmited to a US University to do my masters degree. The duration of the masters degree is 10 months. Since we want to stablish in the US after I finish my masters then we have been wondering which is the best path to go.

I need advise in which is the best path to go, I have two options:

1) We travel together, she has a tourist visa, she could enter the US and then apply for an Adjustment of Status. I have to mention that my wife is two months pregnant and we were planning to travel to the US by August 2015.

2) I was going to ask for a one year deferral to my university and then go for a k3 visa, here in Ecuador, for my wife and I guess I should ask for a k4 visa for my son, when he is born. However we should have all these papers approved by August 2016.

Please let me know what is the best option. We don´t want to fall under a visa fraud or something like that.

He may not be able to go the CRBA route..

I 130 and then an immigrant visa, probably an Ir1 by the time you get it, K3 is effectively dead.

Why no CRBA? And also, to the OP: she can still use her B2 to visit while the IR1 is processing, just the same rules apply as before.

December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Yes, I've been saying IR-1. And in terms of CRBA---- the father is a citizen and as long as he's spent 5 years total in the US (2 of which are after his 14th birthday)....he's good to pass on citizenship, no? I mean I guess we can't assume this is true but it seems probable?

have you lived in the US for 5 years before?

"Children born to an American citizen married to a non-American citizen: The child is a U.S. citizen if his/her U.S. citizen parent was physically present in the United States for at least five years before his/her birth. Two of the five years must have been after the U.S. citizen parent’s 14th birthday.

read my post. if he has lived abroad for 20 years and is, for example, 24 years old, his child is not eligible for a CRBA. if he has lived in the US 5 years prior to his child's birth, yet he does not have any documentation whatsoever to corroborate that he spent that time there, his child is not elibible for a CRBA. So Boiler is correct in a sense...

edit: sometimes the embassy requires more than 5 years depending on the circumstances. I would contact the embassy and/or look at the link I provided if I were the OP.

Ah, well 36 or older. I suppose I was picturing having moved abroad as an adult, not a minor....which I suppose is also possible. But it is certainly not unusual for a man in his late 30s to have a pregnant girlfriend, no?

Hello everybody, thanks a lot for your help. Indeed, I´ve not lived for 5 or more years in the US after I was 14, so my son doesn´t qualify for a CRBA .

On the other hand, the American Consulate in Guayquil-Ecuador told me to go for a K3 first and then go to the US and go for a AOS.

In sum, from what I´m reading option number 1) (going with a toursit visa and then stay in the US and go for a AOS) would be considered fraud.

For the IR-1 visa I don´t know if it is a problem if I´m not living in US territory?

I´ve filed my taxes for the 2014, before that I was a college student, I think I should need another US citizen to sponsor financially, even though I have earned an income more than 35k last year?
