Hello everyone, I need some guidance with regard to how to answer the Question # 18 on I-864EZ form. Below is our situation.

My wife (USC petitioner in our case) is a High School techer. She will be signing a 5 year contract soon. She gets paid Bi-monthly, meaning 24 pay checks in a calender year. Her new school year starts August 1 each calender year. Which means her bi-monthly pay check figure changes after August 1 each year. I am not sure how to answer the Question # 18 asking her annual individual income currently.

I have read a lot of posts on this forum saying multiply the before tax bi-monthly salary by 24. But the issue is her Bi-monthly salary changes during a calender year and we would know exactly how much she would be making for the next 3 years as the teachers union is trying to negotiatie salary with Admin Office for next 3 years.

So my question is, what should we put for question # 18 asking her annual individual income currently:

A) Simply multiply her current bi-monthly pay check with 24 and assume she would be making the same money after August 1 as well (which would be a wrong assumption)

B) Multiply current bi-mnthly pay check with 14 + bi-monthly pay check multiplied by 10 (number of paychecks after August 1).

We also plan on getting a letter from her school district stating her current annual income on official letterhead. I doubt they would wanna put the number suggested by option A above as it wont be the right income for the current calender year.

Oh and I forgot to mention that meeting the 125% poverty line isnt an issue here coz she makes above poverty line currently.

Thanks and hope I have explained my situation clearly here.

you are making this to complicated. just ask her the annual salary, even though she gets paid every two weeks her contract/offer will denote the annual salary.

Her contract doesnt states her salary for all the years. Just the year she signs the contract. Like if she signs a new 5 year contract this summer, it will only say here salary for Academic year 2014-15. For rest of the years, she would be getting a "salary notice" around late July.

We wont be sending in our AOS and IV packages until around this time next year. And salary notice for academic year 2015-16 wont be available when are sending in the AOS and IV packages.

You can only put what you know. Multiply her gross income for a pay period by 24 and use that. Many people get raises throughout the year and don't have any idea what they will be in advance. If you understate the actual income because you don't know at the time of the filling of the forms it'll be perfectly acceptable.

Her school district can verify her salary amount for her current year and the next can be projected by them too. I did that for my support documents.

Can you please explain a little more how you came up with the dollar amount for Current Annual Income for the sponsor? Sounds like you choose the option B as I explained in my original post. Thanks
