Hey everyone,

So 5 minutes ago I received an email advising that the company will proceed with my employment. They seemed to be relatively apologetic and thanked me for my patience.

So in conclusion, for anyone who comes across this thread in the future..... don't accept it if company refuses to hire you on an EAD (unless its a legal requirement you are a US citizen)..... I had a successful outcome and learnt a lot in the process.

Thanks once again for the valuable information gained from this thread, I really do appreciate the advise and well wishes and am believing for good journeys for you all too!! Now bring on my PR interview ha ha

Im very glad it worked out for you. And I very much agree with the others that your post a page back was very eloquently written. I fully applaud you for standing up for what is right and I wish everyone was able to.

You asked a theoretical what would you have done- and its not so much a theoretical question. I shouldn't have to even think about that scenario, that the company would retaliate in such a way. Well, this is the harsh world we live in. (some of us) Its not fair and its not pretty.

I suspect being on a K1 the job for you is a second source of income- not the sole source for your family and you are okay with taking a hit if the company retaliates- meaning you are hired because the law says you must be and the low level management is not so thrilled at being called out and a few months down the road you are given poor evaluations and let go because you 'didnt meet numbers' or came in late too many times, or not working as part of team or quit because you are tired of being given all the crud jobs, the menial tasks, the lousy hours etc. None of which you can prove is part of your legal status- unless they were foolish enough to give you rope to hang them like they did before.

So maybe its not part of your reality. Maybe the concern of the lost income from the job being taken from you is of no concern. And thats fine. Everyones situation is different. Theres no judgement here.

So what would I do? What did I do? Well Ive never had an EAD card. But I was dependent on someone who did for many years. As a sole and only source of income. And its naive to think an issue like this had never come up. If youve never seen my postings before in the forum let me tell you I belong to the rage rage my friend for whats right camp. And when two potential jobs came available A and B and when A said nope wont take you because of EAD card and I freaked out and demanded he go back with all the same stuff that you were advised to here- raise hell, demand the job!! and B was willing to just take him no questions asked. He went with B. Could not risk forcing A to take him and then getting forced out later. It wouldve been our only source of income.

Yes you shouldnt have to think about that scenario, but you do. Many people do. And yeah I guess its slightly uncomfortable to hear the 'rantings' or significantly motivated encouragements of those outside the situation practically demanding the person take action. (I said practically) And then to theorize that those that dont are what? traitors? working against the immigration movement? making it harder for everyone else? Um what about self preservation? What about fear? Its easy to type be courageous and rage rage against the force when you are sitting safely typing it on your PC screen or when you have a fall back source of income.

Thanks Damara for your post. It sounds like you and I experienced a very similar situation. My husband is a 2nd year medical student with no income. His Father agreed to be my sponsor, but I am the sole source of income and we've been living off my savings from my previous job in the UK since November. So when we found out that my job might be in jeopardy it was a scary situation for us both. I think if I was in the position your husband was in, truthfully I also would have gone for option B. But I don't have an option B right now, I kind of wish I did. Because the reality is now that I am very nervous about the retaliation situation you described above. Apologies I have not read any of your other postings, but it just shows that this process is a journey.... a journey which throws curveballs and impacts people very deeply. This forum allows us to discuss, gain advice and most importantly, for me, it has acted as a source of support.

I can understand your emotion at the encouragement of other VJ members and myself.... especially if this is a scenario you and your husband felt that you didn't have a choice but to choose B. That is definitely a position that none of us should have to be placed in. But this encouragement comes from a stance that this cant continue to go on. And, honestly if I hadn't taken action I would have felt even more "useless" then I already do. And I use that word carefully.... I'm sure many of you have felt this way waiting for work authorization, waiting for advanced parole.... basically waiting for your life to start in the USA. I could not be happier that I'm finally with my husband in the same place..... but that doesn't mean I don't want a life. That doesn't mean I don't want to start building a life for our future family. I feel like I've been twiddling my thumbs for the past 7 months..... and when the thought of this job being taken away happened.... I almost jumped at the chance to resolve it. A task for me to do. Its bittersweet... yes, I succeeded in getting my job back. Does it feel completely condition free.... absolutely not. I pray I don't receive any retaliation for acting on the discrimination of the company... but if I do.... well what do I have to lose? I will of course take any action I can. But this time, with the knowledge and confidence that I have the support of many... not just the DoJ... but other people going through, about to go through or already through the other side. I've not moved to the other side of the world, left my family and friends, a job I loved and a country I love to become a 2nd class citizen in my husbands home country. I've come here to be with the man I love with the hope and belief that my husband and I will both, together contribute to society and be treated equally in the process. Yes, this may seem naïve. But, I don't think its unachievable. And yes, my advice is still don't settle if you are discriminated against. The law is there for a reason. We've all abided by it during the process of coming to reside in the USA... so I absolutely will be leaning on it, if and when I need to.

I'm grateful that you shared your experience and I'm sorry your husband felt forced into option B. But I hope that the rest of your journey is curveball free.

There are so many valuable insights in this thread. Don't know if it's sticky-worthy but I would hate to see it "die a natural death" from time.

OP -- a couple of thoughts:

1. Call the DoJ lady back with the news, ask her to keep your file open for a while, and ask her advice on identifying and documenting any potential retaliation (active or passive). The DoJ certainly has experience in knowing what's what, in that regard.

2. Consider keeping a thorough daily diary of your work activities and interactions, to include "who said what."
