my case was rejected, igot the 1st NOA with rejection result, I corrected the mistake and resubmit the package again.

do I have to wait for other NOA ? how I can track my package? I can use the same receipt number of the 1st NOA to know the status online ?

you gotta wait till you receive noa2 which means the application was approved by uscis..depending at what service center you belong to it can take up to 5 months..but if its TSC it will take longer.

The only rejection you should ever worry about during this process is when you go to your embassy interview. The USCIS and NVC you could easily correct it and resend documents but the embassy interview, if rejected means you have to start all over again and thats another 10-12 months of waiting again.

I agree with you, but the rejection which I got was more than 2 months now, and I don't know how to track my second package, I am just worry that it might be lost, even the track of the post office says it's arrived to Chicago lockbox on 17.04.2015.

TSC is Texas service center & CSC ia California service center. Where did you send it to? What lockbox?

In the event of a spousal visa denial at an Embassy/Consulate interview, you don't "start over again," you will be facing a road much more arduous than simply starting over. What anyone in that situation would be facing is the possibility of being issued a Notice of Intent to Revoke which requires a rebuttal. Submission of a rebuttal is no guarantee of reaffirmation. If the petition approval is revoked, then you must deal with the appeals process. There is no time limit on any of it so the amount of time spent waiting could potentially be years.

You are correct that there is more options if the embassy interview comes back rejected BUT has any local immigration attorney would say, the best thing is to start the whole process. Going through the process of getting the rejection over turn requires more time, more money and a expensive immigration attorney because this is not something you do on your own. At least with starting over, it shows more probable cause that the marriage is real on the next interview.

Anybody could google this information if they think i am wrong and anybody could call an immigration attorney with this simple question. Definitely not a good advice to fight any rejection unless there is hard core evidence, probable cause and you know people in the inside.

Starting over could also yield the same result, a refused visa. Even if one does start over, they would have to voluntarily withdraw the other petition without seeing specific reasons why the refusal occurred in the first place. Personally, I would be leery of any attorney advising this, but that's just me.

Good point, it does depend on the reason of rejection. If they lie on the application/petition then starting over would not work BUT if the couple did have a true love marriage but their embassy its in a high fraud country with officers feeling the need to reject people at will, then starting over would be much wiser with an immigration attorney at hand.

This information is not remotely what any of a dozen immigration attorneys recommended to me in this circumstance, nor is it advisable (as Ryan H has stated) or typically fruitful unless the reason for the rejection is known and can be corrected. There are other variables, including whether a fraud marker has been placed on the file. Please avoid pronouncing theoretical absolutes about the consular process when long-time members have experienced quite the opposite in reality.
