Wrote wrong information :(

Hi guys, please help us! My fiance was married twice and he petitioned his 1st ex-wife, but the lawyers we hired to fix our papers wrote the wrong ex-wife on the form where it asks if he have filed other alien fiance/wife before. They wrote the 2nd ex-wife's name, instead of the 1st ex-wife. They also didn't write the result, that it was approved. A month ago, we received an RFE, asking him to give the divorce decree of his 1st ex-wife. USCIS didn't mention anything about the wrong information. But, we are worried now that we might get denied because of this. Is there anything we can do to fix this? Please help... thank you

I would fill out another 129-f with the correct information and copies of both divorce decrees with the RFE. I would also write a memo explaining the mistake and ask to use the newest form you sent with the RFE. Lawyers are humans and make mistakes, your fiance had to sign it accepting that the information was accurate.....so he should have caught it also. That's neither here nor there at the moment though.,

Just throwing it out there cause it happens alot when lawyers do the paperwork, but did both of you fill out intent to marry within 90 days letters?

A K-1 visa is not hard. It is a lot of documentation, and very good proof of relationship. If you had printed the guides section (top of home page) for K-1 visa.,.,.,,.and went down each

requirement, not twice but 3 times.,.,.,,then you would have had a perfect petition.

Why people waste time and money on lawyers is beyond me.

This is what happens when lawyers do your paperwork.,.,.,.,they do not care after they get your money,.,.,.,.,.,they could care less, there is a minimum wage person filling out your paperwork, for the lawyer.

Please, ask for your money back in full for such a terrible mistake, and file a complaint with the ethics board of your state if they do not give your money back. (this works, lawyers scared to

death of this ethics board stuff)

I second Shauneg's suggestion. Having a letter explaining the mistake is your best bet in correcting everything, along with the papers they are asking for. Make sure you are not missing anything to avoid another RFE.

Probably because she will be the 3rd marriage, the guy has filed for 1st ex-wife, and he felt confused with his situation having 2 previous marriages. I guess his situation is scary enough for them to get a lawyer. To each his own. Terrible lawyers though. You'd think with something this straightforward, it would be a walk in the park for them.

I was quite sure I had talked to her before about her lawyer and a seperate RFE. I went and checked my history, this is indeed a second. Terrible lawyer mucking it up

Yes, I also asked for advice regarding our 1st RFE, they need the his 1st divorce decree, my letter of intent to marry him and the name of the site where we met. But, in this problem, we didn't get any RFE. I sent a copy of the whole I 129 package that our lawyers sent me to my fiance yesterday and he noticed the mistake.

I'm confused, USCIS scanned and checked our papers already that's why they knew that we lacked some documents then sent us an RFE, but they didn't questioned us about the mistake or asked us to provide an explanation about it. Is it possible that they didn't notice it or whatsoever? And i think, they'll just focus now on the needed documents in the RFE. I'm not sure

They may have not noticed, but I suggested what to do so that it's fixed now and won't cause a problem later. You are free to do what you wish though.

Yea a new 129 with a letter explaining the mistake, the RFE letter, and copies of divorce decrees...don't need to be originals. That's what I would do. Much better to fix it now, cause if they didn't notice the mistake yet, they will for sure at some point, especially since he petitioned one of them....

1) Fire your lawyer. Waste of money, and all they do is mess things up. Do it yourself.

2) Send in the corrected information along with the RFE info and an explanatory note.

We only got an RFE a month ago, but it didn't ask anything for the mistake. The RFE was about some lacking documents. I think they haven't noticed the wrong info yet.

I'm now confused The status online was still 'response to uscis request for evidence was received. It's been like that for more than a week After we sent the RFE reply.

We don't have an RFE letter for the mistake so I don't know if I'm going to send another I 129 form.
