K1 Packet 3 - Evidence of petitioner’s domicile in the United States

I don't have a lease/mortgage or utility bills, but I've been living at the same place for 9 years and no plans on moving for a few years. Will tax returns, retirement plan statements, passport, driver's license, and bank statements with my address on them be enough?

I would think it would be. If you send the tax returns, I would suggest using tax transcripts from the IRS from at least 3 years back. This would confirm that you used this address with the IRS and didn't just make a return with a particular address. It sounds like you have a good listing to establish a preponderance of your domicile. What about vehicle registration too? Insurance?

If you or your fiance can verbally or write down the lack of a mortgage/lease, then I think that would overcome any suspicions an interviewer may have. It can be a sentence or two. I would even be as informal as to include it on a sticky note on the other documents to establish domicile!

I live with my parents. I moved back there when they bought a business to help them out. It's a huge house, so half of it is just me. I pay rent and utilities but they're all in their names. Do you think a letter from them explaining our situation would help too?

These are all the things I have that I can think of that show my permanent US address:

Voter registration card
Credit card statement
Credit Union statement
Car Loan Bank statement

Student Loan statement
Drivers license
Retirement fund statement
Tax Transcripts back to 2010

Vehicle Registration

Car Insurance statement

Pay stubs from work

Life insurance statement

Passport

How do you live in one place for 9 years and not have a lease or bills or anything in your name? Under-the-radar issues?

I don't think someone who wants to live away from governmental views would be willing to open their lives to all the forms, interviews, and procedures a visa would require! In fact, they would probably be more interested in moving to the petitioner's country!

Maybe he just likes camping? Who cares, really? I've seen people that lease without a lease contract or some people sublet without documentation too.

Wow! Consider yourself domiciled! I don't think an whole letter is required, but you could mention it somewhere. You aren't required to have a leasehold or own a residence to provide evidence of your address - especially if it's been the same address for over a year.

Is this for the interview process?

Yes, for the interview in Montreal. We just got our NOA2 yesterday so I'm still buzzing/hyper from that... then on top of that, I am giving myself anxiety because I want to make sure I get everything together he will need for his interview.

And thank you for your replies.... I really appreciate it :)

I figured we would need to establish domicile for the AOS to prove immigration intent, but I didn't know we had to establish domicile for the K-1 embassy interview.

Congrats on the NOA2! I bet you two are so extremely excited! You two need to celebrate coming out of the TSC prison sentence!!

Sorry to ask this question - is this just a Canadian thing? I don't recall seeing anywhere on the DS-160 that you had to prove your petitioner's Domicile in the USA? <worried>

I think you'll have to look at your consulate's requirements. Montreal's packet 3 and packet 4 shows "Evidence of petitioner’s domicile in the United States" as one of the requirements.

Just following up here. Were you asked to present evidence of petitioner's domicile in the US at your interview?
