Hello everyone, my name is Laura and I'm a Romanian citizen. I have been in the States for almost 5 years now. Currently I'm finishing my OPT. Two days ago I've found out that I'm a winner of the DV Lottery for 2016. I am wondering how long do I have to wait until I can apply for AOS? Do I need to go back to school to keep my legal status until the beginning of the fiscal year? I did fill out the DS-260 and I'm planning on mailing the fee to the Department of State early this week. When I'll get the payment receipt from them I'll work on my file for the AOS. How long is all this process going to take? I really need to be legal here, I can't afford to be illegal because I'm trying to do everything the right way. Any replies back are really appreciated, thank you all in advance and good luck!

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Timeline

To file AOS in the US you must be in status where your lottery number becomes current. It could be the beginning of the fiscal year or the end. If you tell us the first 2 of your number after the alpha part and the alpha prefix. someone can give you a better idea when you may be interviewed.

This will not be over quickly. You will not enjoy this.

Hey my number is EU and is under 1000, is that helpful? Just spoke with my lawyer and he said I should go back when my f1 expires and apply for green card in my country. He said is safer this way than going back to school now after I've already been selected for the dv lottery.

According to my lawyer is already to late to apply for another F1 visa now and in October when my number <1000 is going to be called, how am I going to justify the fact that I want an immigrant visa when a couple of months earlier I applied for an non-immigrant visa. Now, I want to do it the right way and not have any issue. I trust the lawyer, he has a lot of experience and he had a couple of customers that change their status in September and they were called for an interview in November and the immigration officer asked them why they apply for another F-1 when they already knew about being dv lottery winners.

If I go back in August, I'll have enough time to prepare the file for the interview.

When do I need to file the DS-260? I know I can't pay the fee here, but at the American Embassy in Bucharest.

It freaks me out and I don't know what to do.

Ok, first: take a deep breath and relax :)

I'm not an AOS expert but from what you said it does sound like consular processing is your best bet.

Because your number is so low, I'd suggest filing your DS260 ASAP to ensure you get scheduled for an interview as soon as your number is current - probably October. This also means you need to start collecting all your civil documents etc so you have everything ready.

You don't pay the fee in advance when you do consular processing - you pay $330 at the consulate on the day of the interview.

All easy! Relax :)
