Hey everyone,
I am a new member and I want to consult the process of my visa k1 visa.

We received our NOA1 IN 27,October 2014
Me and my fiance lived together for 6 months outside the United States and filed three expedite request .that all have been dined
The expedite requests were rejected because always submitted them through a representative that never asked for evidence to attach
So the last time I talked to immigration officer over the phone (2 months ago) he told me to send it through e-mail with all the evidence - under Severe financial loss
So I sent it with the evidence (I worked on it very hard to get all the evidence) and sent it by express mail delivery to the address that the immigration Officer gave me, I see that from tracking the package they Received it .
To date, no answer to the expedite request
So I called again and talked to immigration officer
And he told me that if I did not submit my all my expedite request the case would have already NOA2

So what is he trying to tell me that right now they are punishing me because I do not want to pay for an 2 apartments lease also on the electricity and water because It would make for me a Severe financial loss (my fiance have no family to support him) I don't know what to do now , I feel that this process is as hell and I can't survive it too much time longer .

Can you confirm something for me first: You say your state is California, but yet you are at Texas Service Center. Can you confirm your receipt number starts with SRC or WAC? If it is SRC = Texas. If it is WAC = please change your service center to California.

The odd thing is if you are not at California, this would be highly unusual. Even more so if your application has taken this long, as California applications do not take that long to process.

However if you are really with the Texas Service Center, be advised they are only officially processing those applications filed August 23rd. That doesn't mean they haven't been doing other applications from September, October etc - but they will not budge to assist you (file a request to get them to move their butts) until their 'official' date moves into October. I don't really get what the USCIS employee is telling you though (they often haven't got a clue), they do usually have to respond to such requests you send, but that probably takes 30-60 days each time (not sure). It can be very difficult to prove a hardship enough for them to expedite. Someone else here may be able to offer better advice.

this is applicant writing , my fiance got a new job in cali so he moved there but originally he's from Texas so the case is in Texas it's SRC unfortunately

any way we shared one Aprt outside of the US before he moved out to get his new job in Cali , Every time we call uscis and we speak with an immigration officer they say something else .

one of them told us that we don't need to send any expedite request cuz he work there for 17 years and he see that we are gonna be approve in 12 -14 days (3 months ago)

one of them say that if we didn't "Harass them" with the expedite request we would probably got already the NOA2 .

My fiance went to there office and meet a immigration officer that she was "shucked" how it been so long and they didn't Handle it yet ,so she promise that she's sending them email and she gonna call him in the end of they working day or tomorrow morning (2 weeks ago ) and of course she didn't call :)

right now we living in 2 Aprt my finace paying everything 2 times , Cuz im not working now ,and no family to support me

im afraid that what the officer told us is true , they we keep our potion down in the list cuz we sent all the expedite's .

When do you think this NIGHTMARE will ends !!!!?

Come join the October 2014 filers at TSC! It seems that, according to data here, they are finishing September filers now and October filers are getting approved. Several October filers, including myself, have gotten approved in the last 2 weeks and there continue to be more oct approvals each week, so HOPEFULLY within this next month or so you'll have your noa2. No one can tell you for sure obviously, but I can tell you that several have been approved so far! :) the wait for noa2 for oct filers is almost over!

Ps- I can give you one piece of advice.. calling USCIS often only gets you frustrated and left without any information. As long as the wait has been, don't worry that your case won't get handled properly because of the expedite request. I could be wrong, but I've never heard of that. a lot of people try for expedites and aren't approved, and you aren't alone in the waiting! We've all had to wait the same amount of time, too, and suffered the same financial losses, unfortunately.

That's great news to see that you got approve in 199 days ,i wish your visa well be issued soon as possible .

i can imagine how you felt when you goy the news ! it's like leaving hell LOL

today we are in the 192 days wait hope for us and everyone else texas service center SPEED UP !!!

I kinda have another question

i have been refuse for a vistor visa 3 times (we want to visit my fiance family)

do you think its gonna effect my interview for the K1 visa ? (i dont know what there wrote about me in there system but eveytime i went to a vistor visa they denied withput asking me any question they read stuff on the comp and denied me :( )

It depends why they rejected your visitor visa. If its because of insufficient ties to your home country (ie they think you might remain in the US) then it shouldn't have a bearing on your K1 - since the whole point of the K1 is that you will stay on in the USA! Just be honest whenever you're asked about visa denials (well you should be honest about EVERYTHING)

If your visitor visa was rejected for other reasons (deceit, criminal history, etc) then those problems with affect your K1.

i'm always honest i don't have any criminal or bad history i have clearance from the police

the reason why i was denied is cuz i didn't have evidence to come back to my country

and they said if i well have more strong evidence i should come back after 6 months

thats what the denied letter from the embassy said .

I always found that a bit odd - you are visiting your Fiance who you desperately want to marry and move to the states and live with, and they want to see lots of evidence of ties to your home country - d'oh??

I always took evidence of Work, family ties, lease and other stuff - but if they had said "stay" and we'll sort out all the details of your home and work later - i'd have stayed like a shot.

We are Non-immigrants with immigration intent!!

The answers we get from calling are pretty inconsistent and I think unreliable. Some reps say one thing and the next time you call they say something different. I don't think it's accurate to say if you hadn't put in the expedite request that your case would have been approved. Officially USCIS is only processing petitions from August 23rd. So the person on the phone just made that up, I think. The good news is that they are moving into October petitions it seems so hopefully it's not too long before you (and I) am approved!

The denial of your tourist visas shouldn't have an effect. USCIS knows that the intent of the K1 is for you to move so ties to your home country are irrelevant for a K1.

As far as the USCIS response to you: if it sounds idiotic chances are it's idiotic. :P

It is possible to try and seek out a senator or representative that might be able to assist you in your case, if nothing seems to ever be moving on it. That's one avenue you could try, so keep that in mind. As for your expedite request, again it's a hard one to prove - but requesting it shouldn't impact the case.

Your previous visa denials shouldn't impact it either. It's a shame really - VWP users almost always can't get a longer term visit visa, and countries such as yours that sadly don't have the VWP have a hard time too (when they shouldn't really if there's proof). How else are we supposed to visit our family/friends?

As far at financial loss, they only care about the U.S. citizen and their obligations, not anything about the immigrant. Even if he's paying everything for you, they don't care. The seriously couldn't care less that you two are paying for 2 apartments because even if you didn't apply for the visa you both would have seperate homes in seperate countries....you aren't in a severe financial loss. You as you were before applying.
