You do not know about chances if you reconcile until you try. You could also already have a deportation order against you so you'd have the 10 year ban and then possibly some.

What is the reason that your husband withdrew the affidavit of support ? Why did you separate ?

Even if you failed the interview, I find it strange that nothing was done for 3 years and you and your husband went your separate ways to

the point that you aren't sure if he divorced you or not. Why did you not stay together ? Why did you not appeal the failed interview 3 years ago

or get an attorney involved ?

You are throwing your husband into this mix of all about the green card and it reads like you are very stressed about the green card and don't really care

about him and want to use him as a means to an end.

I suggest you narrate the whole story so you can get a real answer instead of one short sentence here and there. It is frustrating to read and none

of us have a crystal ball. Half disclosure yields half answers.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Your best course of action is the next available flight home to the Philippines.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

Let me start the story for you.

You came to the US on a K-1 visa. You married the petitioner within 90 days of arrival. You filed to adjust status. You failed the interview due to you and your spouse giving different answers to the same question. I assume this was a Stokes interview where you were separated and questioned individually. So there must have been some suspicion as to the authenticity of your relationship prior to the interview.

After you failed the interview your spouse withdrew the affidavit of support and your AOS was denied.

You and your spouse have lived apart for the past three or so years with little to no contact. Now you suddenly, three years later, want to reconcile with him so you can get a green card.

How have you survived for the past three years in the U.S. out of status? Have you worked? Have you presented yourself as a U.S. citizen?

Have you spoken to your spouse recently? Has he indicated he would like to reconcile?

Why haven't you gone back home in the past three years since your green card was denied?

she sounds like after GC or she has done contract marriage..... she does not wants to go back her country she wants her marraige to be fix just because she got denied for GC... sorry if i am wrong but she sounds like that.

Cold and judgmental.................she is looking for help & it seem her 1st

language is not English.....I agree some ppl are here for the benefits, but

we cant say for sure which ones.

Do you have a child born in the United States? When that child becomes 21 years of age, normally they can sponsor you to a green card but since you entered with a K-1, the only way was through your husband but he withdrew the application so that won't work anymore. In effect your K-1 route is cancelled.

You can try the baby way but don't be surprised if 21 years later, they say you have a deportation order out on you so your adjustment of status is denied.

This actually happened to my neighbor.. the deportation order after a bad interview > mother of a US citizen.

First and foremost, there's nothing wrong with her English. She's not really telling us the whole story that is why everything is vague.

Second, chinita if you really wanted the people here to help you out with your situation it will be better to tell the whole story. You should not be afraid sharing personal story since we don't know you exactly in person and no one does.

I hope you won't mind sharing it, at least people could enlighten you with the best answer that suits to your situation.

just too much ""HERE"" and very little information.,.,., please, we can help you.,but need specific info.
