Talk with your husband and figure things out. It's been 3 years since withdrawn, the interview is only going to get much harder. It is odd that you are asking now and not 3 years ago. Nobody on the internet can help you figure out what to do with your life, decide how you want to live it and live!

That is definitely not true, my ex came here on a k1 seperated we got married and did AOS and everything went smooth. The main thing is crossing the border legally.

This seems very unlikely.

Everything official I have ever read clearly states that if you came on a k1 you cannot marry anyone else and adjust other than the petitioner.

OP- you will have to find out exactly why your AOS was denied and prove that your marriage is real again.

You will most likely be asked why you didn't return home.

How you've been living

If you've been living apart

How you've been eating

What you've done in the past 3 years

Evidence of mingling finances

Evidence of joint assets

Etc

Your story is not 100% clear, but is this the correct summary?

1. You came on K1 visa and got married in 90 days.

2. You filed for AOS, failed 2 interviews, and got denied of GC.

3. Therefore, your husband withdrew the AOS.

4. You failed the interview because answers you gave were different than

the answer your husband gave?

*** What specific question and reasons did they tell you on why they failed your interview? ***

*** Did they say, they don't believe your marriage is real? ***

*** You need to tell us specific details so that we can help better ***

5. You need to be in good marriage relationship with your husband,

before you are qualified and to have a chance to file for AOS and get GC.

If you are not living together, and not clearly talking to each other to a point

you are not even sure whether he filed for divorce, then you have no way to file for AOS.

6. Do you really want to marry him because you love him?

7. What was the problem in your relationship?

Do you believe he still wants to be married to you?

Bottom line is, if you can restore the "true" and "normal" marriage relationship with him,

then I suppose you can file for AOS again (though I don't know what the law is in this case).

But if your marriage is virtually broken (though not divorced yet), and your husband is not

willing to sponsor you for AOS, then there is virtually no way you can pursue the GC by yourself.

Unless there is more to your story, I'm not sure how you're able to accomplish this.

First thing you need to do is restore your relationship and marriage with your husband.

Without that, you have virtually zero chance to file for AOS (again...not sure that's even

possible at this point).

Are your differences cultural or language why U were denied,or

were U both having differences & mad on the day of the interview

and acted out at the interview ? he then deciding chuck it am

withdrawing the petition?, if you both want to make a go of it try

counseling, live together, intermingle funds,pray together & both try

to compromise...If totally over with this marriage you are out of status

and maybe returning home would be best if he is done with it, speak to

an atty....best wishes
