Confused about poverty guidelines...

Hi all

I went for my interview at the consulate a couple days ago. I wasn't declined or approved. In fact she sent me away saying I need to find a joint sponsor as my husbands $48,000 per year didn't meet the guidelines. She said For a family of 4 ( we have two kids) it'll be just over $90,000. Is this right?? My joint sponsor earns $62,000 so I'm hoping they will combine with my husbands pay. $90,000 just seems like too much. And the officer kept my passport and original docs even though she didn't approve me...

Something is not right here...clearly there is misunderstanding.

The interviewer clearly knows the poverty guideline since they are

dealing with several cases everyday. So I highly doubt that they would have

told you $90K income requirement for your family of 4.

Perhaps your husband's earning evidence wasn't sufficient?

What supporting documents did you guys submit?

Does he work a full-time job?

Or is he running a small business or work as an independent contractor that results in varying income?

I believe that they'd want 90k in assets not supported income.

Just over $90,000 would be if you were using assets. Are you using assets or have you shown proof of husband's employment and salary?

Does your husband work in Australia or in the USA?

If the USC is living in Australia and their income will not be continuing after immigration, they cannot use it for the affidavit of support. You would have to supply assets or get a joint sponsor as the CO informed you.

How many are in the household of the joint sponsor? (the joint sponsor would NOT combine income with your USC husband.)

Holy cow is that ever wrong, it's not even close to that! I can't remember what it was, but I do remember that it was ridiculously low.

My joint sponsor earns 62,000 per year and only has one in the household (himself). He is already stateside so I'm hoping him being a sponsor will help.

But that's why they said you need a joint sponsor. The salary must be from the US or if from abroad, it must continue from the same source after immigration. Will your US spouse keep the same job and income from Australia after immigrating to the US? If not, you need three times assets or a joint sponsor.
