whats next? losing all hope :(

Hello everyone, im just very confused, upset, and completley lost since my wifes visa interview last july 2013. let me tell you a little about us. i met my wife through a mutual cousin (her cousin through his moms side, my cousin through his dads side. so basically my cousins dad is my uncle, and my cousins mother is my wifes aunt.) We started talking through facebook around may of 2012, i went to see her for the first time in july 2012; and in december of that same year we got married, and all our family was there her, and mine. i made about 3 trips after my july 2012 trip because i wanted to always see her, and about 5-6 more after we got married .

Ok so when they interviewed us a total of 3 times, and when we had the second interview (seperated) they consulate officer looked at me and siad "look we know you guys are related the U.S.C.I.S investigated" and told me all these fines and bullcrap like i was gonna get scared, but i didnt.. i sent the NVC (and ultimatley took copies to the interview as well) pictures of every trip that i took down there, boarding passes, facebook chats, whatsapp chats, money reciepts, and even letters from friends and family. In the end they only wanted to see pictures, and told us that my wifes visa couldn't be accepted at this time, and that it will be sent back to the uscis for the final decisions

So i called NVC about a week ago and asked them about my case, all they told me was that they saw that it had been rejected but they hadent recieved it yet (mind you i was calling NVC atleast 2 times a week after the interview).

My real question is this, whats next? what will that letter say? how can i prepare? my relationship with my wife is 100% legitimate, im losing all hope and need to know what i can do to not feel helpless and, and hopefully there is still a chance for me and my wife.. By the way im 23 my wife is 21, we have no children.

I think the best decision you can make is to get a lawyer. Your case seems a bit confusing you definitely need someone who can look into your case in detail and has extensive experience. I wish you best of luck

I'm so so sorry to hear about your wife's visa being denied . It hurts when legitimate couples are denied and fraudulent ones make it through the system! Anyhow, as others suggested, consult an immigration lawyer (not just a paralegal), and I would even suggest seeing a few. You want to make sure you get good advice. Unfortunately I know of a couple who was suspected of fraud. Their interview was two years ago. Their case was sent back to the USCIS processing center and they just got a response in February. The letter they received asked for proof/evidence of their relationship. I would assume the same will happen to you. I think after that they can send it back for an interview, or deny and then you can appeal. Wish you the best of luck!

yea that really gets under my skin I know of two relationships that were for money purposes and were approved, and people that are legit could take all the proof in the world and they will still say no

So reading your post, it sounds like you are related to each other, distant cousins? Is that why the embassy rejected it or what reason did they give you? You had your interview a long time ago, they should have definitely given you a reason by now. Involving your state representative can definitely speed up the process, you should give that a go as well as contact a lawyer.

Help from a State Representative or State Senator office can request that an agency consider or reconsiders your case. An immigration attorney can help, but very limited.

I totally understand how you and your wife are not related, even though the consulate made their decision the state representative or senator office can reconsider their decision by submitting proof. I know this can be a bit frustrating as i myself personally know third cousins who have gotten married and granted CR1 visas or K1, and till this day i have asked myself how in the world did the consulate still made an approval decision. Do not give up.

I know of three as well and it pisses me off every time I hear of someone getting approved when the marrige isn't legitimate, then when two people who really love each other go those are the ones who are supposly doing it for money purposes.

Thanks for the clarification. It's been over nine months since your interview and NVC is still saying they haven't received your case?! Have you tried calling USCIS? Perhaps they have it. Definitely get your state representative involved. And if you haven't already, put together proof for your appeal, such as proof that you are not related.

I haven't called the uscis, NVC told me they see it in their system as rejected but that they have not recieved it. I haven't called the uscis because last time I called they told me that I had to call NVC not them unless NVC told me to call the uscis

People are using terminology imprecisely. It's the U.S. Congressman or U.S. Senator who should be contacted. "State" representatives and senators are elected locally on the state level only, and they have nothing to do with Federal or immigration issues.
