I can't speak to the specifics of the case because I don't know any of the details. So I could only say that sponsoring your husband for an immigrant visa is only possible because the law allows you to bring your husband to live with you in the US. If you are not living in the US or if your husband will not be living with you in the US, then the immigrant visa will be denied. If, when your husband does his interview, it is clear that the two of you will be living together in the US, then there shouldn't be a problem.
