I was just pointing out how you can legally kill a baby one day and the next day…..or one second after the third trimester starts….and be charged with murder.

I understand what you are saying.. it is never legal to kill a baby. The point being crossed you are talking about is when it goes from not being a human to a human..

When we are crossing a grey area we have to define a line in other ways - the day before you are 21 you can't drink but when you are 21 you can. Same with driving.. Your argument could be made for these as well - why is it OK to drink at 21 and not at 20 and 364 days? We define a line for crossing a grey area.

At some point that baby was not a human and at some point it became one. We have to assign a crossing point for this because there is no obvious magical turning point that is obvious to all.

Here is another scenario that is odd to me also. A woman in her second trimester decides to get an abortion. The night before she is to get an abortion the boyfriend assaults her (says he hits her in the stomach) and kills the baby. Now the boyfriend is charged with murder……on a baby(fetus) that was going to be killed anyway.

Its a complicated issue and I am sure it will never be resolved.

Think about it this way -- an adult wants to commit suicide, is hell-bent on doing so, but wants to transfer the money in his bank account to his brother's account before he does so. He goes to the bank to withdraw his funds and deposit them in his brother's account. But while he is there, an armed bank robber holds up the bank. After taking the cash, the robber sprays the customers with gunfire. Our would-be suicide is killed. Should the robber not be charged with murder just because his victim wanted to take his own life the following day? One must look to the intent of the criminal and the victim's consent (or lack thereof) at the moment of the crime.

The recent case in Colorado where the baby was cut out of the womb and did not survive ended up being limited to a charge of unlawful termination of pregnancy. There is a senate bill currently being debated to allow a homicide charge for an assault that results in the death of a fetus at any age of gestation.

I think your analogy is different for the simple fact that suicide is illegal. If abortion were illegal then it would be a fair comparison.
