Why would you attend an interview? He needs to withdraw the petition by writing to each certified mail. USCIS the NVC and the Manila Embassy. He needs to include the petition or USCIS case # names, address, and birth dates. He needs to send those letters certified mail here in the USA, and just mail the last one to the US embassy in Manila. He needs to state Please with draw petiton for and the rest filled with the above information.

I spent 2 years in the Phils., with my wife, while waiting for NOA 2.,.,saw a lot of forms, and paperwork especially at the Visa Company we used..,..,.I never saw such a "form letter" letting the beneficiary withdraw the petition.

Not, to say it does not exist, I would just like to see it, as I believe the quote from the 8 CFR, about the petitioner being the one to withdraw the K-1.

Yes, I have a standard form letter from US Embassy in Manila. When a petition is withdrawn it say on it "Withdrawn by Petitioner or Beneficiary, and they circle which one withdrew the petition.....

But you withdrew the petition, not the beneficiary. The fact that Manila has a form that states that line is not proof that a beneficiary can withdraw the I-129F petition. I have not seen any immigration laws/rules/processes that state someone other than the 'owner' of a petition or application can withdraw it, nor have I seen a beneficiary post that they were able to withdraw one.

Where is the proof that a beneficiary can actually withdraw an I-129F petition? As I stated earlier, the beneficiary can contact the consulate to let them know they want to withdraw their visa application (DS-160) because they no longer are seeking a K-1 fiance(e) visa. They can close out their case that way with the consulate and never pursue the visa, but cannot withdraw the actual I-129F petition.

8 C.F.R. 214.2(k)(5)

Validity. The approval of a petition under this paragraph shall be valid for a period of four months. A petition which has expired due to the passage of time may be revalidated by a director or a consular officer for a period of four months from the date of revalidation upon a finding that the petitioner and K-1 beneficiary are free to marry and intend to marry each other within 90 days of the beneficiary's entry into the United States. The approval of any petition is automatically terminated when the petitioner dies or files a written withdrawal of the petition before the beneficiary arrives in the United States.

VOL, there are different scenarios where only one person can withdraw.

Until the beneficiary applies for the visa, the petitioner is solely responsible for withdrawal. But when the beneficiary APPLIES for visa at the embassy, most of the responsibility shifts to the beneficiary. But since this process is based on a relationship between the two, either of them can withdraw.

If the interview is in few days and it wont be a hassle to go, just show up and tell the CO you want to withdraw.
