Wedding early October, NOA1 given January, filed at TSC. Are we screwed?

Hi Guys,

So me and my fiance filed the K1 petition in the new year, thinking we were allowing plenty of time for out wedding in October. Now it seems like the TSC is working on a huge backlog and is still processing the cases from September. We're both panicking that the visa isn't going to be issued in time for our wedding, should we be worried or can I still expect to get the NOA2 in time?

From what I've seen on here, you're definitely going to be lucky to make October. But who knows...with the TSC transfers and supposed effort to clear the backlog, maybe they'll push through and get to your petition!

Hopefully you followed the advice of the petition and the VJ community and didn't book anything non-refundable for the wedding...

No one can give you an answer to that as we cannot predict processing times of the future. TSC has continuously slowed down since I started keeping track in November last year. Just today they posted the official processing time to be Aug 23rd 2014 - which looses them another 2 weeks at least. Current estimates are 220d until NOA-2 - that would late Aug/early Sept in your case. Then you need another 2-3 months till visa in hand.

I cross my fingers for you, but taking current processing times as a guide you will not make it if there are any delays ( RFE) in your case.

Worse comes to worse and don't get approved in time, what then? Can we still marry and apply for a CR1? Can I stay in the states while I do this or will I have to go back to the UK?

No, you cannot stay in the US during the CR-1 process. You have to wait it out back home and it takes 1-2 years.

Do you have any chance of moving the wedding?

No, you cannot stay in the US during the CR-1 process. You have to wait it out back home and it takes 1-2 years.

Do you have any chance of moving the wedding?

I tend to be in this camp. If she comes with the intent to marry and stay, that's immigration fraud. What would she tell the border officer? There are lots of threads about this on VJ, though, so look for those. Lots of people marry and stay in the US to adjust status. However, if she enters on VWP and your petition is denied (which is unlikely to be honest), you would have no avenue for appeal.

If you choose to get married, you'll start over. You'll lose all the fees you've paid and have to cancel that petition and start new with a CR-1.

Applicants are specifically advised to not make any hard wedding plans.

It is highly unlikely that you will make the date you have planned for. I am an October filer, and don't expect to even see my wedding until the time you have planned. TSC is that slow. While there is no guarantee, TSC won't speed up, now that new applications are being routed elsewhere, I still would stay on the cautious side. There is no guarantee they won't progress at the same speed or even slower.

So what's stopping us from having a "ceremony" (i.e a religious blessing but not legally married), me returning to the UK afterwards, waiting for the K1 to be approved, and then come over and get legally married? Unconventional I know but we're not technically breaking the law doing this, right?

I very much agree with you. I've had a number of VJ users disagree this point, though. I always encourage erring on the side of better safe than sorry!

No you wouldn't. But make damn sure no one ever gets the idea you are actually married- USCIS and embassy staff have denied petitions from people they considered married even though the applicants claimed it was not legally binding.

Not technically, no. If USCIS thinks you're married (even if they are told it was just a ceremony), they can deny the K-1. There are some cultures where a religious ceremony before the actual marriage is the norm. The UK is not one of them, though.

You can do an advanced search on VJ for K-1 visas who had a ceremony. I'm not honestly sure if anyone has actually done it and been denied (but I think I've seen some that were). To USCIS, if it looks like a wedding, it was a wedding, and you're no longer eligible for a K-1.

You can have a party with no ministers, altar, or wedding garb to celebrate your love and probably stay out of hot water.

OP: bottom line, I would never advocate doing what you're suggesting. If you come into the US with the intent to do something and do not disclose it to the IO, there's a problem. Even if it's not ''real'' and binding in the legal sense, I could see it becoming a problem quickly. It's unfortunate that you are stuck at TSC, but there is not much you can do at this point.

The problem is that with the recent "transfer"....it's not actually a transfer. It's how they're trying to prevent the backlog from getting worse and/or evening out the processing times between the centers. They're not picking up anyone's file out of the line an sending it to CSC--they're just routing all new petitions to CSC (regardless of where the petitioner lives). It would appear as if the plan is for the Lockbox to route incoming petitions to whichever service center has the shortest "line" from now on. But do nothing for those *already* in the line.

December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. 19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:
