I am a permanent resident, married to an US Citizen and my mom just had her visa denied.

I hear ya and I thought about that too, but that also would be a little silly as I could just petition for them to live here, and they have no desire to live here, my mom is 71 and my dad 67, they live by the beach (I live in KCMO) and all our family are there. Them getting denied visa would just be stupid.

By law the interviewing officer must presume that EVERYONE applying for a tourist visa desires to live in the States. That's what they need to overcome.

The only way to find out is for them to apply.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Tourist visa denials are without prejudice (generally). One can apply as many times as they like and as often as they like. If the circumstances of the denial do not change, the subsequent applications are also not likely to be approved, but sometimes a different CO may see things differently. However there is no rule as to how long you have to wait or how many times you can try.

My mother in law used the "bulldozer" approach years ago. She just kept trying until she was approved. She was denied twice and approved on the third try. Nothing in her circumstances changed from one application to the next.

My mom asked for her tourist visa a week before I came to the US on a K1 visa. She told the consul about it and that I was her only child, and she was easily approved. However, she took several documents with her to the interview, like her marriage certificate, bank statements, letter from her and my dad`s employer, documents showing she owns properties in Brazil, etc - the consul did not ask to see any of the documents, but he could see she had a bunch with her.

So, when your mom reapplies, tell her to bring every single paper she has to prove her ties with Brazil and thing will be fine :)

And someone posted that Brazilians forget to go back home - some do forget to go back and some come here, visit, spend a lot of money and leave. So please, do not generalize!
