Permit me to say this, I didn't say,'legal right'. I simply said, "right as a legal wife". What I mean is she can likely be granted a visa if she proves she only wants to attend the funeral and return to her home country.

That is what confused people, there is no legal right as you said. Anybody can apply for a tourist visa, issuance is discretionary

And maybe my assumption that the wife of someone who died in another country has the legal right of human rights to attend her husbands funeral.

So I guess now there is no set out laws that allow this.

I would have hoped for her sake that there was.

As this is a basic human right.

Saddens me that there isn't.

That's very unfortunate, I'm sorry for your loss. I don't think there would be any way to get here quick for a funeral. I think the media would pick this story up and it might get enough traction that things might change but it could take some time for something like that. You may try writing an email to a senator or congressman in your husbands state. My boss is a former US ambassador and senator, they can make it happen but it's a long shot.

  • As of November 3, 2016 We received an email in regards to not receiving in the mail the Request for Evidence (RFE) , come to find out they really didn't need any additional information. So now the have to wait another 120 more days before we can get an interview or approval. This is some BS.
  • As of February 7, 2017, We received in the mail Interview Date for AOS on March 20, 2017

OP, I am so sorry for your loss. If you still want to move to the US, you can continue your pending I-130 as a widower. I.e it does not cancel or withdraw because your husband passed away. See below link:

I am sincerely sorry for you loss. Your petition will be terminated because your petitioner is dead but I advise you re-apply for a tourist visa stating reasons is due to the attendance of your husband's funeral. The consular may likely grant you the visa because you have the right as a legal wife to attend his funeral. But all this can happen when there is an official date of his funeral. I hope this helps, my condolences one again.
