Unemployment denied...

Hi people,

I filed the unemployment paper after I quit my job to move to the US on a K1 visa. I got a letter back saying i'm not eligible for it because i'm leaving outside Canada so not available for working.

I know I read somewhere on the forum it happened to people and there was ways to fight the decision but I can't find the topic about it.

Did it happened to someone here?

What are the next steps?

Do I still have a chance of having unemployment$$?

I guess in a way it makes sense, since it's trying to temporarily fill the gap

while someone is trying to find another job.

But then again, there is no approval guarantee,

and TSC processing can take many months,

...and you still have to live off of something...

That said, how did they know you are in K1 processing?

You can appeal the decision. Make aure they know you moved to be with a spouse and you really can't get anything until the EAD is approved anyhow.

Did you ROE say you were moving to be with your spouse? I remember that being a very important part when I applied for mine. Fortunately I was the one doing payroll at the time where I worked so I was able to make sure they ROE stated it clearly.

I know other K1 applicants needed to wait for their EAD in order to actually get their EI approved. I'm guessing this is your case as well. You aren't eligible to work in America and you aren't eligible to work in Canada because you aren't there anymore, right? Have you actually moved? Did you apply too soon?

Others have appealed it as NLR suggested you can do but you will need to be eligible to work first.

my last day is today and my manager said the only option is to select "quit due to relocation/moving". I guess that is the right one to select and we can specify with EI why if they ask

Is your manager doing the ROE online through ServiceCanada? Or paper? Because there IS an option I can show you screencap on ours.

I never had --relocating to the USA on my ROE..but it did get denied at first for a different reason.....They gave me 3 options 1) go in person to a hearing 2) phone hearing 3) or write and explain my situation. I chose #3 and won! this was back in 2005. You may have to contact the International side of the EI to get a correct answer.

I would believe you can since you will be the spouse when you file your claim. And I assume we all need to show documentation such as our visas to support claim, if you case you need to show EAD.

But best to call Service Canada / EI to confirm.

She submitted the termination via our HR system and our payroll back end team generates the actual ROE. Lets see what they do, worse comes to worse I can get the ROE amended if EI wants anything specifc

I'm currently on hold with Service Canada... the first guy I talked to said: you were denied because you are not in Canada, so automatically denied. I had to read him their website and he was like: oh... never heard of that, so he put me back on hold and went to get his supervisor.... it's been 30 minutes.... YAY for service canada I bet they are trying to beat TSC

They transferred me,

people at the other place (interstate office) were really nice. They are sending me the new paperwork to fill at my house in the US.
