HELP! A quick question regarding i864

Hi everyone,

I am a newbie here and adjusting from F1 visa. Jus got my NOA1 few days ago. however, I jus realized that I only sent out my partner's records of tax return and forgot W-2 and 1099. So I guess sadly, I am waiting for RFE.

After read thru the instruction of i864, I found out that it stated if you submit IRS transcript, do not submit anything related to tax return documents other than that.

So my question is if I get RFE, will it be enough if I send out the recent 3 years IRS transcript besides 6 month pay studs and employment letter? Cos I noticed that some VJ members send both records of tax return and IRS transcript together. Thats where I got confused since I864 instruction clearly stated do not do so.

I dunno why that pic showing so small. Here is what I quoted from I864 instructions:

"If you provide a photocopy of your tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these Forms if you provide and IRS transcript of your returns rather than a photocopy."

The transcript comes directly from the IRS' records, and the data included on the transcript includes 1099 and W-2 data. Therefore, if you send in a transcript, there is no need to send 1099s and W-2s.

If you send a copy of the actual return, you must send in copies of the 1099s and W-2s.

They actually prefer transcripts, as that shows what the IRS has in their records. However, transcripts are usually not available for several weeks after you have filed a tax return. Depending upon timing, you might have to have transcripts for prior years and a copy of the tax return for the current (2014) tax year. *IF* you are submitting a copy of the 2014 return, you must also have copies of the 2014 1099s and W-2s.

Current pay stubs for 2015 and an employment letter are a good thing.

The instructions are telling you to not send 1040 and W2 if you are using the IRS Transcripts. The transcripts are enough. If you are using a copy of your 1040 then all W2's must be included. People do send in pay stubs and employment letter to give further proof but that is in addition to the transcripts or 1040/W2.

I guess where got me confused is some members here seem to submit both of transcript n actual W-2 n 1099.

I did the same thing, I sent only a copy of tax return for 2014 nothing else. I sent the whole application 2 days after we filed taxes so obviously we didn't have transcript. I ordered the transcript last week from the IRS website so in case I get the RFE I will be sending that back asap.
