Can an expired k1 immigrant come back after losing court hearing

Sounds to me like she is looking for a VAWA??? Who knows. False accusation or not you will likely be compelled to appear in court. And if you sue her will you ever get any money from her? Of course not. You brought her here for a better life. Unless she is some millionaire from Mexico you're just wasting your time. Let her go! But, by all means if USCIS will listen at least report her for not marrying you and they will decide what they want to do, which is likely nothing. Obama will grant her asyllim I'm sure. He breaks the law every day with his "Executive" powers. By the way when I say she is probably looking for VAWA I am not implyineg that she would qualify but she sounds like a real prize.

OP all you should do is report no marriage & leave it alone...move on

If you feel you should clear your name in court you have a right to do

so, I have seen brazen undocumented folks showing up at court for

cases they think they can win. It would be best for her to leave soon if

she ever wants to come back in the future.

People with tourists visas have been turned back entry denied because

they enter the US have babies and never paid Jackson...happens in Miami

all the time as they flit in and out with no regards to financial responsibilities

would be surprised the info CB ave at times in their system

Well, I am really surprised on how people are making assumptions about the OP case and feel they have the right to ''fill the hidden lines of his story''. REALLY that he needs to give every little detail (If she went to a hotel, motel, friend's house or whatever?)? It doesn't change the context and he gave enough elements for people to understand the situation and giving useful advices other than questioning if his ex-fiancée went to a 5 starts hotel or a cheap one!



Things happen and sometimes we never know what kind of trouble we are getting ourselves into! It can happen with anyone here. Sometimes we are fully sure we know the person who has been sleeping by our sides for years but no, we don't. We are human beings and all of us are unpredictable! How many cases we have seen here of people deeply in love who applied for visas and suddenly their lives turned out to be something completely different? Well guys, s*** happens so don't assume the OP is joking around! The situation is not easy and I bet it's easy to judge when nobody is walking on his shoes.

Other than thinking about if she will ever get a Visa again (We never know), I (PERSONAL opinion) would definitely look for legal advice and see what you can do in order not to get accused of something you didn't do. It's not fair to be charged for something you never did (I would fight with all my strengths to prove I am innocent). Nobody here is the Judge to question if you're lying or not and it's the Justice role to investigate. Other users have told you to report the situation to USCIS and please do so but I believe you should definitely take care of the accusation against you!

Just found out today she married an older guy she knew for a few days..... They apparently seemed legal advice and were told that my ex has to obviously leave to Mexico, but can get her visa within a year to come back to the states.... This area of law I don't know if its just a year or longer considering she's been here 5 months illegaly...

We never married... She was my fiance at the time so she married someone else but I was the petitioner

Yeah, so she will have to go back to Mexico & then her new husband will have to file a Spousal Visa for her. But they could be problems because she married someone who was not the petitioner while she was here during her 90 days that she was supposed to be marrying the petitioner.

-Disclaimer: I could be wrong about what I posted.

Edit: I'm assuming she married this guy within the last 30 days remaining on her Visa after she left you, though it's possible she married in her overstay period, which changes things but I know not how.

Her visa expired November 25, so that's why she's rushing to leave next week,her ban would be coming April 25... Just married this guy last week, her frown is visiting her from Mexico and said that my ex doesn't even know the guys last name, she met him in a casino and spent 4 days with him haha
