AOS from F-1(Marriage to a USC) Annual income question

Hello

I have a question. We lived in a different state last year and employment options were not so good there for my USC spouse. She had to use all her retirement money(close to 85k) and now we have moved to another state. So in her 1040, her using her retirement is considered as her income. Now for this year she has transitioned in two jobs, the second being a full time, permanent job.She had to work part time and earn around $244 a week and meanwhile she did a lot of job hunting and found a full time job which would pay her around $30k a year. She just received an employment letter for that(it states that she will be making $14.25 an hour). The job starts in May. So we just got married and are about to file(the first week of April) .

So my question is, how to we go about filing the paperwork for this? I mean in terms of Annual income. Her part time job wasnt paying enough to qualify for the poverty line limits but her new jobs does, but at the same time, she just got accepted and wouldnt be working until May. What should we write as her annual income? I just do not want any RFE.

The job is not even starting, how can you prove she will have this job long enough to cover you? It is time to find co-sponsor.

Have far along are you in the process if you have just sent in the I-130 petition.you will have enough time

I started a new job about a month before I sent the petition in for my wife. When it was time to send in the Aos documents it was about 5 months my case was complete with no problem having a new job

Dont we have to file I-130 and AOS packet alltogether?

yes my mistake but still it will be some time after you filed before the case is approve, enough time to prove current income

Timeline

There is not necessarily plenty of time to provide evidence of the job starting in May. I have seen a few people posting about how quickly they are getting interviews, even before receiving the EAD/AP. You just never know. They could get an RFE for proof of income before she even begins working.

A job offer letter cannot be used. They won't accept future income as current income. Any USC or LPR domiciled in the US that is over 18 can be a joint sponsor, as long as they meet the income requirements. I have no idea if he using her ex-husband would have you incur more scrutiny. Some exes stay friends. Provide plenty of evidence that the marriage is bona fide.
