Montreal Interview - Divorce Certificate for Petitioner Question

Hello All!

I have my interview on April 10 and needless to say I am getting nervous.

I have never been married, but my fiance (petitioner) has been married. I have a photocopy of what looks like the court papers of his divorce. We submitted this with the I-129F with no problems.

My questions are will they ask for this? And is the paperwork I have enough or do I need an original certificate with a seal etc? I've never really seen a divorce certificate and I thought his looked odd, but he got this from his ex-wife.

Yes - in my experience when I went through as a K1 a few years back, we needed my Husband's actual Final divorce decree with the raised (or printed) seal to show as the original. He had other court papers but both he and his ex received a signed, stamped with a seal .... decree.

If he doesn't have that he may have to go visit or call the county where the divorce was granted to get a copy.

Unless its changed in the last couple years?

PS - the papers you have a photocopy of could be the decree - have him look at the original which you need anyway for the interview

I didnt need it for my CR1 interview In 2013.

You will need a certified copy with a raised seal. We got a 221g for this because I only gave my fiance (now husband) a photocopy.

We just ordered the Divorce Certificate from VitalChek. It cost $77.25 US for anyone who may need it. we did pay the $20 extra to have it UPS Air Mailed just in case. It states it only takes 1-2 days for processing, so fingers crossed we should have no problems receiving this before my interview on the 10th!

Thank you for everyone's help! Fingers crossed. That was my only concern of all the paperwork we had. Better to be safe.

btw, when i had mine in 2012 they did not ask for either (mine nor his), they were more interested in my seeing my separation agreement (as only one child of the 3 was applying).

This thread has me all worried. I didn't realize the P3/P4 checklist was applicable to both petitioner and beneficiary. Does this mean the petitioner also needs to provide original birth certificate, divorce certificate, AND police certificate?

petitioner won't need a police certificate.

You never need a US FBI certificate to immigrate to the USA.

Logically, it made no sense. But YOU NEVER KNOW WITH THE USA, THEY CRAY CRAY!

Would it just be original birth and marriage certificates then? Everything they have of the petitioner would be in the I-129 they have. And I'm assuming they don't need to take new passport photos either.

Perhaps. They asked for mine, but it was kind of in a tricky way. The CO made a statement that my husband had been married once before. I corrected him that he had been married twice, and then he asked to see the paperwork (all originals). I can see how it might be mainly a K1 thing though.

I susopect so - maybe with the CR1 you already have your marriage cert for eachother and they don't look further back?
