My son is 2, he was born before our marriage.

I'm still 24, Haven't stayed in the US for years. I'm a permanent resident alien.

But can my son go with his mom with Philippine passport? I'll be filing his CRBA in the US as soon i meet the required years.

You can't file a CRBA in the US since it's done abroad at a US Foreign Service post. (It's the BA in the CRBA)

So in your 24 years, you've spent all of them in the Philippines? You don't meet the 5 years living in the US, 2 years of which were after the age of 14 requirement?

If not, it looks like you'll have to file another I-130 for a CR-2 for the kid as Darnell suggested because at this point, the kid has no visa to stay in the US. The airlines won't let him fly or USCIS/CBP won't let him in without one.

Just as an aside, how are you proving US Domicile for your wife's I-864 if you've never lived in the US?

Jan 13, 2015 - MNL Case Number & Packet 3 Received via email (I emailed the IV Unit-Manila requesting these on Jan 5, 2015 and Jan 12, 2015)

Jan 21, 2015 - NOA2: Mailed (via PhilPost!) paper/hard copy delivered to our place here in Manila.

Jan 22, 2015 - Packet 3: Mailed (again via PhilPost!) paper/hard copy delivered to out place here in Manila.

Feb 24 & 25, 2015 - Day 1 & Day 2 of Medical @ SLEC. Immunizations given on Day 2, thankfully

Mar 5, 2015 - USEM Interview Appointment - IR-1 Visa Approved! (CEAC Status updated to ISSUED afternoon of interview day)

Mar 10, 2015 - 3pm - Received SMS saying IV Package ready for pickup at 2GO MoA. Picked up at 5pm. (Shipped/Picked Up/In Hand on 3rd Business Day post interview)

Mar 13, 2015 - CFO Manila - Done

Joint sponsor or not, you personally have to fill out an I-864 and you still have to prove US Domicile.

I suggest you read up and do your research regarding that. The fact that you replied "joint sponsor" to my question when it's you personally that needs to show proof of domicile in the US, and not your joint sponsor shows this. You need to read up and be prepared because one of the questions the US Consular Officer asked me on the day of my wife's interview was "Sir, do you have anything to prove US domicile?" You very well can't tell him or her "joint sponsor." So definitely research and read up, using both US Gov't sites as well as threads here in the DCF forum regarding domicile. Bare minimum, read the documentation and the instructions for the I-864 regarding domicile that I referenced in my earlier post. Since you're just at the filing stage, you still have some time to figure this out.

Personally, I showed my US Social Security Card, 2 US Based Credit Cards, NY State Driver's License, NY State Voter ID, Mail I got delivered to my parent's address in NY, a letter showing that I served Jury Duty in the State of NY, etc.

The U.S. Domicile Requirement for Petitioners Living Outside the U.S.

A petitioner living outside the United States and who has not maintained any ties with the United States, and who wishes to qualify as a sponsor must demonstrate that:

1. He or she has taken steps to establish a domicile in the United States;

2. He or she has either already taken up physical residence in the United States or will do so currently with the applicant;

3. The sponsor does not have to precede the applicant to the United States but, if he or she does not do so, he or she must at least arrive in the United States concurrently with the applicant;

4. The sponsor must establish an address (a house, an apartment, or arrangements for accommodations with family or friend) and either must have already taken up physical residence in the United States; or

5. Must at a minimum to state that he or she intends to take up residence there no later than the time of the applicant’s immigration to the United States.

Although there is no time frame for the petitioner to establish residence, the sponsor/petitioner must in fact, have taken up principal residence in the United States. Evidence that the sponsor has established a domicile in the United States and is either physically residing there or intends to do so before or concurrently with the applicant may include the following:

1. Opening a bank account;

2. Transferring funds to the United States;

3. Making investments in the United States;

4. Seeking employment in the United States;

5. Registering children in U.S. schools;

6. Applying for a Social Security number; and

7. Voting in local, State, or Federal elections.

I only qualify at numbers 1 and 2, and i already have a SSN
