filing single in my tax return

Timeline

I married in 2014 but I filed single in my tax return for 2014. Will it have any problem when I send AOS packages?

I will use I-864 WZ.

I used Tax agent and they said I don't need to choose married because wife is not living in US now.

Does anyone had same situation?

If you were married in 2014, then you should have filed married filing jointly or separately. It doesn't matter if your spouse is not in the US. I'm not sure what happens since you've already filed single as far as amending the return, maybe other folks can advise.

1/11/14: Got married
3/13/14-11/2/14:
I-130
1/26/15-3/17/15: NVC

5/28/15: INTERVIEW - denied

6/8/15: I-601/I-212 waivers received

11/17/15: I-601/I-212 waivers APPROVED

maybe just attach a note explaining. did you file as head of household? i just went through the same thing (but have a child to claim as a dependent) and the IRS website says "You are considered unmarried for head of household purposes if your spouse was a nonresident alien at any time during the year and you do not choose to treat your nonresident spouse as a resident alien. However, your spouse is not a qualifying person for head of household purposes. You must have another qualifying person and meet the other tests to be eligible to file as a head of household."

I filed single as well based on bad information from my tax agent. I filed a 1040x amended tax return and changed my status from single to married filing separately and I sent the amended tax return in for our I-864.

Did u file 1040x after u file ur tax return? Will it change any amount too?

I filed the 1040x about six months after I filed my tax return. I included a copy of the 1040x in my documents that I sent for the I864.

Thank your I will also file 1040X. hope it won't take long to get it! ?

Oh and it didn't change the amount because I guess the tax deduction is the same for single as for married filing single. I just sent in a copy of the 1040x that I sent in to the IRS. I guess it would have been better to get an actual tax transcript after the IRS had received it, but I didn't have any problems just sending a copy of the 1040x that I sent in.

Ok, I will submit 1040x, I felt relieved that the amount won't change. I was supposed to send a copy of 2012, 2013, 2014 Federal Income Tax Return. I didn't prepare any transcript.

Did your send transcript for 3 years too?? or just sent a copy of federal income tax return? ?
