Your fiancee got "confused", I get that. But for them to ask a 3 year old? I find it appalling.

My kids aged 5, 6 and 7 also went with their father to the interview but was just asked for their names.

Of course the senator has no authority to over ride the decision and I never said that but I have seen it several times that with a senatorial 'request'

a second interview was granted. It is a slim chance as I said but why the heck not try it ? What does he have to lose ?

It does not have to be over until the petition is in the diplomatic pouch on it's way back.

For Philippines, yes, all visa applicants (regardless of age) should be present at the interview.

That's why I suggested to contact your senator to request a second interview asap before the case actually gets returned.

It's a very slim chance but all you got left now to try and fight this. If she does get a second interview, be there !

3 year olds aren't old enough to get a true answer from and they will say anything, the child said yes he still sees his father and your fiance said

she saw him last in 2011 (corrected from 2005) so of course all this back and forth is contradicting and confusing. This all looks bad to the CO

and she needs to get her dates straight.

If they will not grant a second interview then the best thing for you to do is get married and file a CR1.

There are red flags here for you to consider yourself. A neutral person looking on would worry about the woman changing her story to say the last time she saw the father was conception. The normal reaction by a parent to a child making a drastically wrong answer about living together with the father would be to explain the question to the child again. A four year old who has never seen his father his entire life is going to be pretty clear on that question though. He doesn't have a father in that case, and it will be a big thing to a kid that age.

I'm almost afraid to ask the age of the other child but either way it is still problematic, but for different reasons. Is the other one older or younger, and is it the same father?
