Philippines Annulment and Lawyer Help!

i never heard annulment here in the philippines getting denied. my ex filipino husband annuled me..the processing took 11 months for him...no appearance in the court..meaning i dont need to appear in the court and it will be a faster to process coz the court called me...disinterested party. it only cost him 150k in everything.

March 2014 approved at USCIS
june 2014 NVC received
march 2 2015 sent aos and iv package
march 8 i emailed nvc request to expedite my case
march 13 approved expedite request
march 17 in transit status in CEAC
march 19 case file at US embassy
march 23 first day of medical at Slec
march 29 personal evaluation...passed!
April 6 immunization
april 13 interview at USEM. under Administrative Processing Reason; Medical result was still not forwarded by SLEC.
After my interview i called SLEC they told me they forwarded it at USEM same day of my interview.
July 29 I emailed SLEC to confirm again when did they forwarded my Medical Result at USEM. They replied...forwarded April 13.
July 30 status update date change FINALLY.
September 2015 went in US embassy to withdraw my passport coz I've waited for how many months and no approval yet. Only to find out my case file has been sitting in the corner ...no one reviewed my medical result. to make the story short, I took medical again for the second time , then after a my medical result released, I have my visa on my hands.

December 2015... 10 year green card arrived
December 2015 Driver's license issued..yay! <p>

Yup you can be disapproved. Many have. Explaining your process I thought that it went smooth for you and I can't believe it was only 11 months and 150K. Usually, I read that some it was years and 250K plus.

no...this time annulment will only take 10 months to one year maximum. 150k-200k.

yes it went smooth for me. i didnt attend any hearing BUT my ex husband need to exaggerate the story and i was the one accused being Narcissistic ...(because he has the money) and thats the reason why I attended Personal Evaluation at St. Lukes.

believe it or not i was annuled 2004. And now annulment is not an extraordinary process in the philippines.

Timeline

filing an annulment in 2004 is way different than filing it now. Courts are more strict now. Supreme Court is auditing courts which release decision in one year.

I can recommend an annulment lawyer in Manila, he charges low yet very efficient.

just a quick update-

we opted to go ahead with divorce proceedings in Singapore. her time there is sufficient to file, and for around $2k, we've gotten everything squared away. filed everything, should have a positive result back in October, according to the lawyer. hopefully, we can get a k1 with it, philippines cenomar be damned. the ex gave us a bit of a hard time for a few months, regarding signing off on the paperwork, but in the end we finally got him to agree.

next hurdles for us will be the k1 process and figuring out if it's possible for her 13yr old son to come to the US. between a difficult ex and the delicate dance that this loophole will require to circumvent Phil gov, i don't know how good our chances are. anyone know if a k2 denied for any reason would hold up a k1, or if there is a better approach to getting the k2 locked up?

Did the lawyer add into the divorce decree that the mother has sole custody of her child. Though Philippine laws mandates in the absence of the father, the mother to have custody, there may come a time that you have to prove that to some government agency.

"A statement like this would satisfy any government agency to wit "That the sole responsibility for the custody, care and support of the minor child named XXXX XXXX XXXX now XX years of age, shall remained with the mother". That statement would avoid any future problems with immigration for any country including the Philippines.

You should really have no problems, but you'll see what bridges you will cross during the processing. It's best to have the K1 and K2 process together and immigrate together. Just my opinion from experience. Mine was a K1 and two K2's.

Update: Divorce approved Nov 25th in Singapore. Proceeding with K1 paperwork, although there is the slight time delay per shipping signed original docs. Onwards and Upwards!

I agree with you. I filed mine Oct 2011 and got annulled Oct 2012. My lawyer said it is a lot safer from audit by supreme court, paid only 150k and only took 1 year

so a few observations, as this is unfolding:

- the US gub'mint doesn't seem to have any issue with the divorce decree being from outside Phils. As long as it sees a line of continuity from marriage-disolution from recognized foreign governments, they don't mind that it isn't from within the same country. This circumvents the need for CENOMAR from philippines.

-not sure where this leaves us further down the road when we want to visit the Phils later. with a name change, she might not be looking at any problems on re-entry. without a name change, not sure if it wouldn't cause a dust-up from some fiesty government officials when we go back. maybe the philippines would reluctantly recognize that the marriage was satisfactorily dissolved? dunno, we will have to check- after she's here, of course.

-all of our history together precedes the official divorce decree. stretching back to our first meetup in 2013, virtually all of our evidence packet consisted of proof pre-divorce. the visa center didn't mind.

-if there are any filipinas in a similar OFW situation where they have a few years of working abroad in one country under their belt, i am becoming inclined to believe that this route is actually preferable to seeking annulment thru the filipino court system. it's been infinitely easier than the rigors and hoop-jumping that we went thru when we tried to follow that path, and at a reasonable cost, to boot. i'll update as we experience the embassy at Sg, by way of comparing to the circus that is the manila embassy/st lukes.

That divorce will never be recognized by the Philippine government under current laws. The only divorce they will recognize of a Philippine citizen is when they are married to a non Philippine citizen, and that citizen filed for the divorce. If both parties of the dissolved marriage were Philippines citizens, then it would never be recognized. Because the marriage will never be recognized, she will not be able to get a passport with her new married name. There will never be an issue with her returning to the Philippines though. Technically though, her ex husband, who is still her husband under Philippines law, could charge her with adultery for her relationship with you. BTW you can also be charged under this messed up system of not recognizing divorce. As long as there's never a problem with her ex husband, this will not be an issue. So don't ever do anything to piss him off if you intend to visit the Philippines.

Another thing, there are a few rights granted to foreigners who are married to Philippine citizens, you will not be able to take advantage of them. The effected ones I can think of is inheriting any property she owns there, and getting a 13A visa.

Some day the Philippines will legalize divorce and all these weird legal quirks may go away.
