Timeline

Question for a friend. He filed a I-130 petition for his family when he was an LPR. Wife got approved except for the kids. It happens that my buddy became a US citizen since he's in the Armed Forces, and didn't know that it would affect the current petition or his family. All fees have been paid, and unfortunately, the kids were denied and they asked him to do a seperate filing for them. Anyway, he's currently in the Philippines right now after being deployed in the Middle East. Can he do DCF while he's there although he is not conisdered a resident? Will his military status have a bearing for the DCF filing? Also, does he have to pay the visa fees, and AOS fees again, as well as medical? Thanks in advance for your guy's input!

Not sure if his being Active Duty will change things. Usual requirement is having been here for 6 months. Only way for him to know for sure is to set an Infopass Appointment with USCIS Manila. And I suppose yes, he'll have to pay the fees for the Petition, Visa, Medical. No AoS fee since that's not required when doing it DCF.

Dec 11, 2014 - NOA1: Not sure what to put here, Dec 11, 2014, Dec 24, 2014 or something in between.

Dec 24, 2014 - NOA2: I called USCIS @ USEM on Jan 5, 2015 and was told the I-130 was approved on Christmas Eve. Thank you Santa!

Jan 13, 2015 - MNL Case Number & Packet 3 Received via email (I emailed the IV Unit-Manila requesting these on Jan 5, 2015 and Jan 12, 2015)

Jan 21, 2015 - NOA2: Mailed (via PhilPost!) paper/hard copy delivered to our place here in Manila.

Jan 22, 2015 - Packet 3: Mailed (again via PhilPost!) paper/hard copy delivered to out place here in Manila.

Feb 24 & 25, 2015 - Day 1 & Day 2 of Medical @ SLEC. Immunizations given on Day 2, thankfully

Mar 5, 2015 - USEM Interview Appointment - IR-1 Visa Approved! (CEAC Status updated to ISSUED afternoon of interview day)

Mar 10, 2015 - 3pm - Received SMS saying IV Package ready for pickup at 2GO MoA. Picked up at 5pm. (Shipped/Picked Up/In Hand on 3rd Business Day post interview)

Mar 13, 2015 - CFO Manila - Done

Now disposing/selling/giving away/shipping to the US stuff from 14 years in the PHL and 4 years together before heading to POE.

Hi Manilaraf! Just want to confirm about AoS fee. Are you sure, its not required to pay?

Because my hubby & I went to manila embassy last week and ask if we have to pay the AoS?

The lady officer said "YES". For me and my 2 children separate of 120$ ×3.

That's 360$ savings for us if its true!

Please confirm this.

Ok, let me be more specific.

We didn't pay for any AoS fee. If you look at how the process works, people pay that when doing the USCIS Lockbox System in the US, since you have to send AoS forms to the NVC. We hold on to the I-864s until the day of the interview. We do not mail them to NVC or USEM beforehand. Or at least, we didn't.

Here, all we paid for were: 1) I-130 Petition, 2) St Luke's for the Medical, 3) US Embassy for the Visa on the day of the interview.

Before heading to the States, we'll pay the Green Card/whatever it's officially called Fee on the USCIS ELIS site so that the Green Card is paid for.
