Request for I-485 additional information

Timeline

My wife submitted her tax returns yesterday. This is the first time she has submitted US tax returns, and we are unsure if they have been completed correctly. If there is a error on the tax return forms that we've missed, will USCIS still accept them? We will be submitting other supporting information for proof on income such as pay slips and employer letter.

did you use turbo tax? or another tax program?. I think those are pretty accurate. The USCIS is not a tax authority. It is the IRS you have to worry about for tax mistakes .

I suppose that is why the USCIS asks for transcripts...

She used taxact.com, I've just looked at the numbers on her form and they don't make a lot of sense. The gross income is negative!

Will USCIS still accept it even if there are errors on it? As I mentioned before, I have other evidence to submit as proof of income.

didn't you say she didn't have any income anyway? I would think if you submit all the supporting documents and a letter of explanation, it should be fine.

No. She does have an income well above what is required for I-864, however up until November 2014 she had been working in the United Kingdom. So the numbers on her W2 refer to her earnings between November and the end of the tax year.

Yes, you did it wrong. A correct return would have her UK income (converted to US $$) in Line 7 of the form 1040. That is the line where wages are reported. Then they are excluded on line 21, with "Foreign income" written in the blank on Line 21. It would look something like this--

7. Wages, salaries, tips..............$20,000

-

-

21. Other income......Foreign Income -$20,000

22. Total income............... $0

-

-

-

37. Ajusted Gross IIncome....... $0

-

-

40. Standard deduction.......$6,200

41. Subtract..................... -$6,200

42. Exemptions ........... $3,250

43. Taxable income.... $0

44. Tax.......... $0

And of course you would have form 2555EZ showing she was allowed the excusion Line 21.
