I-751 Two Year conditional Greencard Dilemma.

Shes still live in my rental, we havent divorced yet so i cant just kick her out.

This is why i try to find way to not let her come back to the US since shes in vn till june 15. Her green card will expire on june 16. If i can find a way to block her green card the at the airport and they would deny her entry. Its easier to fight when she cant come back here as supposed to already living in the same house.

That's probably not going to happen. Short of her being a terrorist, you won't be able to block her entry into the US as long as she has a valid greencard. You're much better off concentrating on getting yourself situated and starting the divorce.

Doe she have a lease on your rental? Is she paying rent? If not then start eviction proceedings.

Can he make Infopass appt to inform USCIS of his concerns and have an alert placed against her file using her green card A# that is accessible when she applies to CBP for entry at the airport?

Don't take it the wrong way. I don't want to go through all the hassles of collecting evidence now to present to USCIS, only to know that deportation is a lost cause.

If i know that she can get deported after I present all the evidence, then I would do it right now right away, but the odd is not that great for me.

USCIS is not going to look for your spouse actively to deport her.

But you should report her for fraud/sham marriage nevertheless.

You collect all evidence and show it to a FDNS officer at the local USCIS office. Get in via infopass (https://infopass.uscis.gov) , ask for the FDNS officer, and be prepared with a file full of stuff, a written narrative as well, referencing the evidence that you have.

Don't file ROC jointly with her.

With no evidence of bona fide marriage, your spouse will have a hard time ROC by herself.

imo, if you start now, and the fdns officer agrees with you, that there is a ton o fraud there,

her A-file will get noted

and

there will be note in the CBP computer to hand over the green card at any immigration control point. But you have to do stuff, nowish.

Perhaps you've read my stuff, about what to do, who to talk to, how to get in? yes? no?

He has been living in denial for 2 years

If I can stop her from coming thru the airport and have the immigration send her back, that's ONE less battle to fight.

Imagine now she comes thru, then she hires a lawyer, and it's a long struggle battle. Which one would you rather fight?

She will NOT automatically get deported if you\she don't file to get the conditions removed.

But..

Her green card status will automatically be terminated.

She will be out of status as of June 17. That means she cannot enter back on that green card if she ever leaves the US to enjoy her shiny new $50K house.

If you think she'd hire a lawyer, you should too. Based on your initial post, she seems to have broken quite a few US laws (immi fraud, potentially abandoning residence, evading taxes).

depends on what you present to the fdns officer,

and what the fdns officer does after reading yer stuff that you put in his/her hand.

He has no evidence. She can say she was scared, he was violent blah blah. His word against hers at the moment. All he could do is divorce, move, and sever all ties with her.

Please for the love of God do not help this woman. My husband and I just spent 3 years in AP hell at the Islamabad embassy because they thought our marriage was fraud. Helping this woman to be a nice guy is a slap in the face to people like me that did everything the right way and was still penalized. Not to mention the fact that you will committing fraud yourself. If she is doing this to you, why in the world would you want to help her?

If he can get to an FDNS officer then yes. The first line USCIS infopass line are not FDNS.
