A good friend of mine only sent the petition itself and the required documents from USCIS and payment. She didn't send one shred of evidence, no photos, no emails, no chats, no affidavits, nothing, zero, zilch, nada and her husband's petition was approved in 4 weeks(this was in 2011). She flew through NVC and at his interview they asked him only 3 or 4 questions and he was approved with no AP, and they didn't ask him for evidence at the interview either. He is from Syria. Front loading isn't a requirement. only a recommendation. When I sent my husband's petition I only sent the required documents along with a half a dozen pictures and a copy of passport stamps from one trip I took Jordan to see him. We were approved in 97 days with no RFEs, and at the interview at the consulate they didn't ask for any additional evidence. I guess my being at the interview was proof enough. We just finished removing conditions on his green card with no RFE and they didn't call us for an interview. I was very thorough with evidence for the removal of conditions because I was bound and determined not to get an RFE and I was not keen on the idea of an interview. Luckily we avoided all of it.

Wow! this has given me so much more hope, all we have to do now is pray that our case is picked up by someone that's in a good mood, lol. What I'm gonna do now is just gather additional evidence on top of what we already have. Any idea why we might have been sent to Nebraska Service Center though? I was told that Texas Service Center has legislation over North Carolina so I was surprised to see that it was sent to Nebraska.

So are you saying we should save our energy and scrap the K-3?

Ah! Yes, scrap the k-3! We considered it, but after talking to LOTS of people and researching a lot, we learned the k-3 was designed for back when they had such a huge backlog of petitions to process, that the whole CR/IR 1 was taking two or three times the length of time. It's nearly obsolete now, and could just delay it even further.

Glad to hear you are scrapping the lawyer!! It's always better to send in your photos, chat logs, etc....too bad the lady didn't! If I were you, I would wait a little bit then start calling your service center to see if you get an RFE. So sorry to hear she didn't send it!

The issue with front loading is really country/embassy specific. Some get by with only the bare requirements and others need extensive front loading.

Factor into this if you have any red flags to overcome.

The CO will have already seen your entire package before you get to the interview and likely has already made up his mind or is leaning toward a yes or no

decision, so if he doubts you have a bona fide relationship he will likely refuse to issue the visa or ask for additional evidence. That is the reason front loading

is important for many countries. A well rounded quality front loaded package can tip the balance in your favor. At least bring lots of evidence for the interview !

Well I'm guessing Jamaica may be on the list of countries with red flags, so that has me a bit worried, but we have lots of pictures, and he will be visiting me again in July so we will have even more pictures, and we have more proof set aside that if we make it to the embassy I will be taking with me

Thank you! We just got NOA2 on Monday! Yes, Jamaica is one that is tough. Whether or not you get an RFE for USCIS...I would bring everything you possibly can to your interview. We submitted a lot of evidence, but I'll still be sending my husband with all the proof. I've heard of the embassy not even asking to see any of it, but rather be safe than sorry, right? Especially if your dumbass lawyer never sent any of it. I'm talking everything from your husband's flight itineraries, any hotel reservations, anything! I got the advice to send each other greeting cards through post once in awhile (birthday, anniversary, etc) Even though there are many more convenient ways to talk, it's another way to show your genuine relationship. And bring those cards to the interview! I'll be keeping my fingers crossed for you two!

The petitioner can be waiting outside of the embassy or in the USC part (where all USC are allowed ), hand over the passport of the petitioner

and tell the CO that she/he is waiting outside and would be happy to answer any questions should that be needed. This is done in Lagos frequently

and can be helpful. The CO will know you cared enough to be there and have made another visit.

The lawyer my husband got to work with only sent our marriage certificates as evidence although we gave her our skype call logs, pictures etc. I am now wondering if this will cause a delay in our case (she told him that we did not need those evidence until I get to the embassy). Has there been anyone in a similar situation that eventually got approved? Ohh and we have already received our first NOA.

We also used an attorney, and only our marriage certificate was sent. We had no problems. But, my spouse was from a low-fraud country (Australia). I think that has a lot to do with it.
